Under the non-delegation doctrine, lawmakers who hold OUR voting power are not supposed to give away the keys to our Kingdom, except with standards that sufficiently govern performance that it can be said that We the People still control but have just delegated to a manager (like the EPA). The EPA and other regulatory agencies stretch the limits of credulity in terms of whether Congress can really control them (certainly can't micromanage them), but the modified bailout plan goes way beyond the pale in delegating democratic power (obtained via voting) to an essentially unaccountable Board, but calls it, deceptively the Financial OVERSIGHT Board.
