Protest planned before hearing in Florida lawsuit

CNN) – Victor DiMaio, the plaintiff in a refiled lawsuit aimed at forcing the DNC to seat Florida’s delegates to the Democratic convention, has announced that a protest will be held in Tampa, Florida on the eve of the hearing in his case.

The “lawsuit was filed long before the first vote was ever cast or counted,” DiMaio said in a statement released Monday. “How do you ignore the fourth largest state in the nation and millions of Florida voters who exercised their right to vote?,” he added.

In early April, DiMaio refiled in Tampa federal trial court. The new suit alleges that the DNC discriminated on the basis of race and national origin in violation of federal law. In particular, DiMaio contends that the DNC allowed Nevada and South Carolina to hold their presidential primaries prior to February 5 because of significant minority populations in both states.

A hearing is set for Wednesday in DiMaio’s case. In papers filed with the Tampa federal trial court in preparation for the hearing, the DNC countered that its rule on scheduling primaries does not amount to discrimination on the basis of race or national origin and does not discriminate against any individual voter or against the voters as a whole in any state.

The DNC also said that national political parties have a constitutional right under the First Amendment to determine how delegates are selected to their nominating conventions

This is a few days before the really big blast in DC so Clinton supporters can yell at Howard Dean and the Rules Committee and declare they are cheated, mistreated, and unloved. Howard Dean will be in NY that day, but who the hell cares. They will yell at anyone.

Heck, Stephanie Tubb Jones is even taking a bus there from Ohio. I don't know how many other states.

BUT back to Victor DiMaio's Tuesday protest somewhere in Tampa. It doesn't say where or what time in the article. I keep hearing he is "uncommitted" like the other folks filing lawsuits. However, I really don't think he is.

The two latest lawsuits against the DNC...two pending, two dismissed.

Throughout the 10 months since DiMaio originally filed suit, he has insisted that he hasn’t had a dog in the hunt, so to speak. But recently, he appeared on a local television talk show where he argued that Hillary Clinton would be a stronger candidate in the fall against John McCain. And unsolicited, he mentioned Obama’s decision in Michigan.

I really don't call that uncommitted.

And the other fellow with a pending lawsuit had a private meeting with Hillary Clinton the day before his lawsuit was filed

"State Sen. Steve Geller was asked to attend a private meeting with Hillary Clinton this afternoon after her Broward campaign speech. Still an undeclared super delegate, the Senate Democratic Leader from Cooper City was expecting a full court press to win him over to the Clinton camp.

Surprisingly, he said he has not received the same invite from Barack Obama.

“If I had gotten an invitation, I certainly would have gone,” he said.

Geller tomorrow has scheduled a press conference at his law office to announce a “significant development expected to have national impact.”

No, he is not announcing his endorsement in the presidential race. And he probably won’t for some time.

The next day he filed his lawsuit against the DNC for discrimination.

Okay, Tampa folks, where is the site of the protest and what time?

Why does someone need to have a protest before a lawsuit is heard in court?
