7. Permanent stain on * administration
Bush has, in effect, already said the winning the election means never having to say you're sorry. Therefore, the torture memo and the statements on the Geneva Convention were ratified by the election. I think Bush will pull this nomination only if he feels that pulling it (probably for some fake reason) will cost him much less than going forward.

I think he might pull it only if the Democrats (and possibly some Republicans) choose to really filibuster the nomination. If the media would decide that this issue is at least as important as Scot Peterson, his nomination would be dead almost instantly. I haven't seen any polls, but I doubt there is a majority of people for torture.
