But note that this is not the way it works today for FFL sales. FFL dealers are required to keep exquisite records of all incoming and outgoing firearms, by make, model, and serial number, where they came from, and who they were sold to. This information is required to be kept on file and accessible to law-enforcement personnel to aid in criminal investigations.

While I could hope that NICS for private transactions would not record such information, I'm not hopeful that it would be implemented that way. Most likely if NICS becomes required for private transactions they will require that both parties present themselves to an FFL and the transfer be conducted, and documented, in the usual way.

There's no way they'll ever open up NICS for such open queries without records of the transaction because anyone could say that they performed or submitted to the check but there would be no way to say for sure if it actually happened - it would be completely voluntary to comply.
