in that it invokes the "extraordinary circumstance" option detailed in the pending agreement.

But - here's the kicker - who do you think decides what constitutes "extraordinary"? It's not delineated anywhere, and it won't be, and my guess is that it will be defined by the Senate Majority Leader or the President of the Senate.

Guess who they are.

The rightwingnut browshirts won this one, believe me, and Frist is their hero.
