...According to the report by patrolman Vincent Ferrara, Watson was driving his Ford Ranger pickup when he was flagged over at the checkpoint. Ferrara reported that Watson's eyes "were extremely glassy and bloodshot," that he smelled of alcoholic beverages as well as "the distinct odor of marijuana" and that his speech was slurred. He said Watson told him he'd had one or two drinks at a friend's house but was able to drive.

Ferrara said he asked Watson if he had any medical conditions that would prevent him from participating the sobriety tests and Watson told him no, noting that Watson stated "that he was an attorney and that he does these tests with his friends while out at bars."

In an eye coordination test, Watson was unable to follow Ferrara's finger smoothly, Ferrara's report stated. On a heel-to-toe walking test, Watson was told numerous times to wait until Ferrara finished explaining the test before starting, but Ferrara said Watson repeatedly started before he was done talking.

Ferrara said Watson raised his arms instead of keeping them at his sides and failed to make heel-to-toe contact while trying to walk a straight line.

"Watson stated at this time that he had a back problem, which he did not tell me when asked earlier," Ferrara said in the report.
