The Coleman campaign maintains that this is a re-count and not a re-vote, and that ballots not counted on election day should remain uncounted. The Franken campaign would like those mistakenly-rejected absentee ballots counted. The state canvassing board has ruled that it does not have the authority to settle that question, so the question will likely go to the courts or, as the OP outlines, to the US Senate.
