Because things like that simply don't apply to the USA unless the USA wants them to (i.e., unless it gives them an advantage). Any pretence at wanting a "level playing field" is pure political bullshit.
cf., the "right" to "pre-emptive attacks" ... imagine the cry that would go up if someone pre-emptively attacked America and caused the loss of life on a scale that we've seen in Iraq ...
