13. There was a law for conspiracy in TX in 2002, as well.
A law professor has been quoted saying the language of the 2002 law ("any felony") would include this issue but, that is the technicality being fought over. Assuming that the law against corporate donations precedes 2003, which seems obvious, and that breaking it was a felony under state law, which is what seems to be the case, then conspiracy to break that law is itself a felony under the 2002 law, even though it didn't say, "any felony, including violations of the election law".

It seems Earle is not powerless to deal with the potential lack of clarity.
