Well, not that there was much mystery about it, but Attorney General Michael Mukasey immediately put any ambiguity to rest when he began his testimony before the House Judiciary Committee this morning.

Chairman John Conyers (D-MI) put it to him: since administration officials have disclosed that CIA agents waterboarded three detainees, "are you ready to start a criminal investigation?"

"No, I am not," was the direct answer.

His reasoning was a repeat of his answer to Sen. Sheldon Whitehouse (D-RI) last week. The CIA waterboarded those detainees with the authorization of a Justice Department legal opinion from the Office of Legal Counsel. So the Justice Department "cannot possibly" investigate, he said ......

Oh yeah, what a big stinkin' surprise this was. Yeah, take a republican at his word again. Good move, idiots. Who were the 6 again? Schumer? Feinstein?

So yeah, spare me the part about how voting for even the most mealy mouthed concilliatory, pandering democrat is better than voting for a republican or not voting is?

2. I partically agree with the AG
The people who actually carried out the water boarding shouldn't be investigated. However despicable the action, they relied on what they thought was sound legal advice. The better investigation would be of how the decision was reached, what was the level of outside influence and did anything like this happen before the "opinion" came down. Also did the people pushing it know that it was illegal and tried to gloss over the illegality with a legal opinion.

From those that set the stage to those that carried it out - they ALL should be hung and if you have any reason to believe otherwise I would save some rope for you too.

It's the Nuremberg reasoning all over again.

We told you it was all right. We aren't going to hold you accountable for YOUR actions because of that.

Never mind that other people refused to waterboard. Never mind that maybe your own conscience should have told you the technique was wrong. We said it was all right when it wasn't, and so we aren't going to hold you accountable.

6. Agreed.
It's illegal to follow an illegal order. I was just following orders is not an excuse for commiting war crimes. If you commited or ordered war crimes you should be prosecuted as a War Criminal.
I want to see Bush marched out of the White House in handcuffs and Impeached. Impeachment shouldn't be off the table it should be the table.
