If the situation was as terrible as you theorize, they could sue for custody and show the mother is not fit.

What if the boy had a happy life with his grandparents.

Patti Hearst was quite fond of her kidnappers, after they finished brainwashing her. Should we have excused her kidnapping because she was happy?

I'm just playing devils advocate, cause we don't know the circumstances that motivated the grandparents.

The fact that their solution was a class A felony demonstrates they were not fit parents.
