The 21 years is for the squatter to take the property through adverse possession which is not what the current squatter cases concern. The cases I have been seeing in the news concern squatters either using a fake rental agreement to establish alleged tenancy or were squatting in the house long enough to argue they had tenant rights. In both instances, the police would be called and instead of kicking the squatters out, they would state it was a civil matter and the property owner would need to go through the unlawful detainer process which in many states can be a long, arduous process.

In Texas, squatters can be charged with criminal trespassing, but law enforcement doesn't do anything.
