Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officers judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. Montana is one of nine states with provisions that say that the right of recall extends to recalling members of its federal congressional delegation, pursuant to Montana Code 2-16-603, on the grounds of physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.
Section 2 of Montana Code 2-16-603 reads:
"A public officer holding an elective office may be recalled by the qualified electors entitled to vote for the elective officer's successor."

And on Friday, management announced that nurses who joined the strike on Thursday would not be allowed to return to work that day, effectively locking out about 70 percent of all nurses from those hospitals. (In true management fashion, they allowed them to return to work todayChristmas Eve.)
Protesters at Occupy Long Beach weren't feeling the lockout, so they decided to do something about it. Last night, several protesters somehow snuck past the battalions of security guarding Long Beach Memorial and staged a "die-in," with their most effective point being made sometime before they all fell to the ground with "illness": "Something's wrong inside, if the nurses are outside!" Then they lie writhing until the Long Beach Police arrive.
