§ 1983. Civil action for deprivation of rights

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

Moving quickly on Christmas Day after the US Senate voted 86 - 14 to pass the National Defense Authorization Act of 2011 (NDAA) which allows for the indefinite military detention of American citizens without charge or trial, Montanans have announced the launch of recall campaigns against Senators Max Baucus and Jonathan Tester, who voted for the bill.

Montana is one of nine states with provisions that say that the right of recall extends to recalling members of its federal congressional delegation, pursuant to Montana Code 2-16-603, on the grounds of physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.

Section 2 of Montana Code 2-16-603 reads:

"A public officer holding an elective office may be recalled by the qualified electors entitled to vote for the elective officer's successor."

Echoing complaints heard by people facing foreclosure nationwide, the Boehms claim that Bank of America repeatedly asked them to send in their paperwork related to the loan modification process, and repeatedly claimed to have lost it or never received it.

“I’ve done everything they asked us to do,” Mike Boehm said, “We filled out all the applications sometimes two or three times, after they lose it or can’t find it, whatever the case.”

“I want to believe they just lost it, but after 408 days of doing everything they said and they still can’t approve us for a modification, I don’t know what the answer is anymore,” Mike Boehm said.

Occupy Long Beach Stages Hospital "Die-In" in Support of Striking Nurses

The California Nurses Association and National Nurses United in Los Angeles and San Francisco have been battling with Sutter Health hospital management for three months over basic worker's rights: they want better health care, staffing, and sick leave. On Thursday, they staged a one-day strike—their second—which reportedly attracted over 6000 nurses from nine hospitals, with a majority of workers striking. And on Friday, management announced that nurses who joined the strike on Thursday would not be allowed to return to work that day, effectively locking out about 70 percent of all nurses from those hospitals. (In true management fashion, they allowed them to return to work today—Christmas Eve.)

Protesters at Occupy Long Beach weren't feeling the lockout, so they decided to do something about it. Last night, several protesters somehow snuck past the battalions of security guarding Long Beach Memorial and staged a "die-in," with their most effective point being made sometime before they all fell to the ground with "illness": "Something's wrong inside, if the nurses are outside!" Then they lie writhing until the Long Beach Police arrive.
