(115,683 posts)Both the president and the vice-president would have to be dead or incapacitated (at the same time) for the speaker to become president. There was no vice president during the period between the assassination of JFK and the inauguration of Hubert Humphrey as VP in 1965 because at the time there was no provision for appointing a new Vice President. The 25th Amendment, ratified in 1967, says: "Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress."
Therefore, if Hillary is elected and then becomes unable to serve, with the result that Bernie is president, Bernie would then be obligated to appoint a VP right away. Or, if Hillary is elected and Bernie becomes unable to serve, Hillary would have to appoint a new VP. So, because of the 25th amendment it doesn't matter if both the president and the vp are old.

(8,616 posts)I think Pres Clinton should offer (and Sen Sanders should accept) a cabinet level post as ACA Czar. While we've been fiddling, Rome is burning. New challenges to ACA have arisen from the courts and the insurance companies. We need someone who is driven, feisty, unwielding, crusty and devoted to Universal Health Care. Ironically, Sanders can do more for health care as a cabinet level executive than he could ever thought of doing as Pres. Let him make our ACA more like Denmark's! Hill's attention will be diverted in a thousand different ways after inauguration; she needs a pit bull who can live, breath and concentrate on health care and health care only. What better way to preserve Obama's legacy, and get us to where we need to be with regard to Universal Health Care.
ps: We might even unite the party.

(114,904 posts)Perhaps, but a successful cabinet stint might provide for him a perch from which he'll be much more successful in leading his revolution. Don't get me wrong, it would be a suicide mission, and I think he and Jane would have to think long and hard before accepting. It would make him the most hated man in the Government. But he might be the only person that can do it, as he's not beholden to any of the health care stake holders. Not to the AMA, ABA, insurance industry, big pharma, etc. I think he and Hill should announce that the mission is to make ACA a successful European style mandatory health care system within so many years, and if the players don't cooperate, Single Payer will be adopted. This would send a loud and clear message to all involved.

(114,904 posts)First of all, I assure you that Bernie wouldn't accept if asked. Secondly, he's too old. Paradoxically, he's not too old to be President. A VP is the backup. That's a compelling argument against him. Also, I don't think that would mean that his supporters would be on board. And can you imagine Bernie being a mouthpiece for something like a no-fly zone in Syria?

(115,683 posts)If any VP, old or otherwise, can no longer serve, the 25th amendment requires the president to appoint a new VP. So that wouldn't be a significant problem (it was before 1967). But of course there are other reasons why this scenario is unlikely (though it would certainly be an interesting development).

I don't think Bernie would like to be picked for a largely ceremonial post. Nor, I suspect, would most hardcore supporters from either camp want to see it. Bernie supporters would see it for what it was, and wouldn't want him to be second fiddle to her. And on the other side:Hillary's corporate donors would go batshit crazy.

If Sanders takes a VP slot with her on the top of the ticket, she'll get zero new votes and he'll destroy his own credibility.
We don't support Sanders as a cult of personality. We do it because he represents what we want and she doesn't.
