Illinois lawmakers approve concealed carry gun bill - Shall Issue, no carve outs

"The Senate quickly passed the bill 45-12-1. The House vote was 89-28." Well over the votes needed for local preemption and to over ride any possible veto.

"SPRINGFIELD --- State lawmakers today approved compromise legislation to set up rules on who can carry concealed guns and where they can be carried.

Illinois is the last state in the nation not to have some form of concealed carry on the books, but a federal appeals court overturned the state’s long standing ban in December and gave lawmakers until June 9 to come up with regulations to allow it.

"Don't let your constituents go off the cliff, this is a historic day for law abiding gun owners in this state," said sponsoring Rep. Brandon Phelps, D-Harrisburg."

Going to be hard to blame this on the GOP, since we have Dem super majorities in both the State Senate and the House and the core of the bill that was passed came from Brandon Phelps "D" and was supported by the Speaker, Mike Madigan.

Under the proposal, concealed weapons would be banned from numerous sites, such as CTA and Metra buses and trains, casinos, government buildings and stadiums. But lawmakers said the bill would allow people to carry concealed weapons in restaurants where alcohol is served but more than half of the sales are for food.

A five-year concealed weapons permit would be issued to applicants. Law enforcement could object, and an applicant could appeal to a seven-member board designed to have people with such credentials as former judges or FBI agents. A person would have to complete 16 hours of training before getting a gun.

I assume that last bit should be "...before getting a permit", right?

I do wish my state was moving in this direction, instead of the opposite...

Even though it took the legal system to get it done, it's about time IL fell in line with the rest of the country.

Next up, getting the 8 "may issue" states to implement "shall issue" licensing.

Look to California and CT for the latest in legislation to actually STOP the blood/gun-flow. We're better than this, I hope.

Or just celebrate this with another rousing game of "Fondle the firerarms"

Better check to see if they're loaded first, though.

because they don't address any problems. California banned a bunch of guns that are not used in crimes, being used by people who don't commit crimes. CT? Same thing.

will do nothing to reduce crime. It's plainly obvious to those that aren't wearing blinders, that these laws are aimed at the law abiding gun owner, not at reducing crime.

... the actual numbers show that violent crime continues to drop, in spite of record high gun sales.

So instead of cute, funny and insightful, it just sounds really, really stupid.

But feel free to pursue your faith based belief that more guns equals more crime. The 1st amendment protects your unique religious belief.

He can veto the bill, in which case he will suffer a huge political embarrassment by being overridden by the legislature, or, he can sign it and point to it during his re-election campaign.

If he does, he faces the fact that the Seventh Circuit will implement their ruling on the current Illinois laws prohibiting carry at all.

The case is Moore v. Madigan. The court ruled that "The Supreme Court has decided that the amendment confers a right to bear arms for self-defense, which is as important outside the home as inside." The court gave Illinois until June 9th to correct it, or the current laws would be tossed as unconstitutional.

What's really interesting is that J. Posner authored the opinion. Posner is well-known for his position favoring gun control.

Idaho 2.3 liberal gun regulation
Oregon 2.1 liberal gun regulation
Maine 2.0 liberal gun regulation
Utah 1.9 liberal gun regulation
Iowa 1.5 liberal gun regulation
Minnesota 1.4 mostly liberal, like Michigan. BTW, Manitoba's murder rate is about the same as MN's
Rhode Island 1.3 medium pretty liberal
Vermont 1.3 liberal gun regulation
New Hampshire 1.3 liberal gun regulation
Hawaii 1.2 strict

While Wyoming had a spike that year, 2012's murder rate is back to 1.1-1.4 range.
nonstates, but part of the US, have gun laws that make Hawaii look like Vermont

Guam's murder rate is about 1.2 and have FOID and registration. Like Hawaii, it is also out in the middle of nowhere and not in the way of any smuggling routes distribution hubs that. Or at least, operated by criminals who are more civilized in dealing with their business disputes.

If he signs it before the June 9th deadline it becomes law and the Illinois State Police have 180 days to get the system set up and running.

Result; Quinn has his impotent ranting and raving thrown back at him in the primary next year by Madigan's daughter and anybody else who runs.

If Quinn waits, or uses a "pocket veto"; on June 9th Constitutional carry (open and concealed) goes into effect as if no bill was passed and 200 home rule cities have to scramble to set and enforce their own new gun laws until he does.

Result; Quinn looks like more of an idiot than usual.

If Quinn tries an "amendatory veto", which Quinn has played with in the past - substituting completely different bills; Constitutional carry still goes into effect June 9th while a special session eventually overrides his veto on a straight up or down vote.

Result; Quinn pisses off the municipalities and looks like an even bigger idiot for stalling the inevitable.

The Chicago political types hate that they were forced into this, but the last thing they want is constitutional carry with all their local gun laws suspended and the subsequent court cases they'd have to pay for if they start enforcing some arbitrary laws.
