Twitter sues U.S. over demand for records on anti-Trump account

Twitter Inc said in a lawsuit on Thursday that it had received a demand from U.S. officials for records that could reveal the user behind an account opposed to President Donald Trump and that it was challenging the demand in court.
The lawsuit over the anonymous account was filed in federal court in San Francisco, where Twitter is based.

A probable US government employee using an Alt_USCIS account moniker is embarrassing the tRumpanzees and they desperately want to shut her/him down. That would be a violation of free speech.
They are such amateurs, even the "special agent", that they demanded the identity be revealed by a deadline the day before they faxed the demand.
As amateurs, they claimed a section of law about commercial goods applied even though no commercial or non-commercial goods were involved.
They said that the person behind the moniker had a right to respond to the demand but then they claimed that Twitter was forbidden from contacting and informing the person.
Executive summary: The government officials are behaving like fascists in an attempt to shut down free speech they don't like.

The account, one of several alt government accounts that appeared in the wake of Trumps ascent to the presidency, was used to express public criticism of the Department and the current Administration, according to Twitters complaint.

Twitter is suing the federal government over what the company says is an unconstitutional effort to expose the identity of the creator one of many anti-Trump "alt" federal agency accounts that popped up soon after President Donald Trump was sworn in.
The short-message social-media site sued the Department of Homeland Security Thursday in U.S. District Court in San Francisco, seeking to void a summons a Customs and Border Protection agent sent to the company demanding that it turn over records identifying those behind the "@ALT_USCIS" accounta Twitter handle apparently used by one or more employees of the U.S Citizenship and Immigration Services.
"Defendants may not compel Twitter to disclose information regarding the real identities of these users without first demonstrating that some criminal or civil offense has been committed, that unmasking the users identity is the least restrictive means for investigating that offense, that the demand for this information is not motivated by a desire to suppress free speech, and that the interests of pursuing that investigation outweigh the important First Amendment rights of Twitter and its users," Twitter's attorneys wrote.
CBP warned Twitter not to notify the owner of the account, but the company did so after CBP said it did not intend to obtain a court order blocking such disclosure. The social-media company complains that the summons it received was issued under a federal law that pertains to investigations of illegal importation of merchandise.

Twitter Inc on Thursday filed a federal lawsuit to block an order by the U.S. government demanding that it reveal who is behind an account opposed to President Donald Trump's tough immigration policies.
Citing freedom of speech as a basis for not turning over records, Twitter filed the lawsuit in federal court in San Francisco and said that the account, @ALT_uscis, claimed to be run by at least one federal immigration employee. The acronym CIS refers to U.S. Citizenship and Immigration Services, and the account describes itself as "immigration resistance."

Twitter said CBP was obligated to demonstrate that some criminal or civil offense had been committed and that outing the account holders' identities was the least restrictive way to advance the investigation.
The American Civil Liberties Union, which told NBC News that is representing the account holder, similarly argued that the government hadn't presented a strong justification for demanding the information.
"In this case the government has given no reason at all, leading to concerns that it is simply trying to stifle dissent," said Nathan Freed Wessler, a lawyer with the ACLU's Speech, Privacy and Technology Project.
In any event, Twitter's lawyers wrote, "Permitting CBP to pierce the pseudonym of the @ALT_USCIS account would have a grave chilling effect on the speech of that account in particular and on the many other 'alternative agency' accounts that have been created to voice dissent to government policies."
