New Orleans police have arrested Euric Cain, spokesman Tyler Gamble said Monday (Nov. 23). He is wanted in the Friday shooting of Tulane Medical School fourth-year student Peter Gold.
Police arrested Cain, 21, at a home in the 2200 block of Delachaise St. in the Milan neighborhood. He was wanted on charges of attempted first degree murder, second degree kidnapping and armed robbery.
Officials plan to release more information at a 2 p.m. press conference that will also discuss Sunday's playground shooting in Bunny Friend Park.
Gold, 25, was shot in the stomach when he intervened to help a woman who was being dragged toward an SUV on the 1000 block of St. Mary Street. A chilling video shows a man then attempting to shoot Gold in the head three times -- and the gun jamming. Police identified Cain as the assailant Sunday.

(31,997 posts)He shot the guy in the stomach which is often fatal and then when the guy is laying on the ground he attempted to shoot him three times in the head. The video tells it all.

I could be wrong, I am not a lawyer, but I've seen some "Law & Order SVU" marathons.
I would not like this guy to get off because he was over-charged and the jury doesn't buy "premeditation" or some such nonsense. He needs some time away from society.

(56,582 posts)I may be misremembering, but I think Louisiana doesn't have a Murder 1/Felony Murder distinction, and this pretty clearly sounds like an attempt at felony murder.

An argument for such statutes is that if Al, Bill, and Chuck rob Ed, and one of them shoots and kills Ed, then you don't end up with three not guilty verdicts when Al swears he doesn't know what happened because he wasn't in the room when Ed was shot, Bill swears he doesn't know what happened because he wasn't in the room when Ed was shot, and Chuck swears he doesn't know what happened because he wasn't in the room when Ed was shot -- you just charge all three with felony murder
An argument against such statutes is that if Ed's heart coincidentally stops during the robbery, Al, Bill, and Chuck may all be facing murder charges

UPDATE, 11:30 a.m. Tuesday: On Tuesday morning, a judge ordered 21-year-old Euric Cain, the suspect in the shooting of Tulane medical student Peter Gold, held without bond.

Cain has a history of arrests. He pleaded guilty in July 2012 to illegal carrying of a weapon and in May 2014 to stealing a motor vehicle.
His most recent brush with the law came earlier this month. A carjacking victim told police Nov. 2 that he had tracked his stolen cellphone to the corner of Second and Freret streets. When he went to the intersection, he told police, he saw Cain holding his phone and then getting into a Toyota Camry with another man.
Cain and a passenger in his car, Anthony Herbert, were both booked on possession of stolen property in the amount of $900. He pleaded guilty the next day to a lesser count of illegal possession of stolen things under $300 and was quickly released.
