Third Federal Court Formally Strikes Down Louisiana's Gay Marriage Ban

Louisiana Gov. Bobby Jindal (R) said he would wait for a third and final federal court ruling declaring bans on same-sex marriage unconstitutional before recognizing gay marriages in the state, and Thursday morning a district judge gave him just that.

Thursday, federal District Judge Martin Feldman reversed his previous ruling upholding the state's gay marriage ban, as reported by [link:http://www.nola.com/politics/index.ssf/2015/07/louisiana_court_same_sex_rulin.html|The Times-Picuyane.

Louisiana's laws and constitutional amendment prohibiting marriage for gay couples violates the Fourteenth Amendment, the judge said. The order was a procedural motion to address the litigation specific to Louisiana in light of the Supreme Court's gay marriage decision, which effectively legalized same-sex marriage nationwide Friday.

Friday, the Jindal administration said it would wait for direction from the U.S. Fifth Circuit Court of Appeals before recognizing the marriages of gay couples in the state. Wednesday, after the appeals court ordered the reversal of the previous district court decision in favor of the state's same-sex marriage ban, the governor's office delayed the recognition of gay marriage yet again, until the district court formally struck down Louisiana's ban.

Two Federal Court Rulings On Gay Marriage Still Not Enough For Jindal

The Supreme Court has already said that state bans on same-sex marriage are unconstitutional, a decision that a federal appeals court reiterated Wednesday applies to Louisiana's anti-gay marriage measures. But Republican Gov. Bobby Jindal is holding out for yet another ruling before he allows the state to recognize marriages between gay couples.

Wednesday evening U.S. Fifth Circuit Court of Appeals reversed an earlier district court's decision in favor of Louisiana's same-sex bans, citing last week's Supreme Court decision. The appeals court sent the case back to the district court to issue a new order. A Jindal spokesman told The Times-Picayune that the state will wait for that district court to speak again before it falls in line.

"Our agencies will follow the Louisiana Constitution until the District Court orders us otherwise," Mike Reed, a spokesman in the governor's office, said.

The appeals court also acted on state bans in Mississippi and Texas Wednesday, directing lower courts to rule against anti-gay marriage measures once and for all there. States were free to began granting same-sex marriage license as soon the Supreme Court declared marriage constitutional right for gay couples, however some states insisted on waiting for lower courts to rule on the cases that apply directly to them before recognizing the marriages.

Cruz and Jindal are kindred spirits in they wake up with a hard on of hate for all non white cons, even though they arent white.

If they disagree with the order, they can sit there and stew for a while, then get over it.
It's a done deal.
