The military is specifically mentioned as a duty of Congress in the Constitution. The federal government does not mandate schools. Local and state government does.

Schools and education are not mentioned as a duty of the federal government in the Constitution. The federal government can not just do anything it wants. It has to be a duty given to it in the Constitution.
