(20,886 posts)And I think his pick might be more liberal since he has nothing to lose at this time. I may be dreaming, but if I were he, that's what I would do.

(26,355 posts)I predict they'll filibuster every nominee at least until after the election.

(19,537 posts)Now if Obama compromises TOO much to what the Republicans want in terms of a nominee, perhaps the Democrats should filibuster it, though hopefully that will be avoided. Now's the time to stand together and push hard for a more progressive nominee. The Supreme Court has been allowed to have some very partisan corporate and right wing decisions such as Citizen's United, Hobby Lobby, McCutcheon, disempowering the voting rights act, etc. based on judicial activist notions of corporate personhood amongst other things.
We should demand our congress play hardball, and tell Obama he should be standing with them when they do so, and force Republicans to bend over instead of us "bending over".

(34,857 posts)If no filibuster, you only need 50 votes. Democrats, and the two independents who caucus with 'em, as well as Biden. That puts the Democrats, who probably would hold at 100% on any nominee, three votes short of the 50 needed. I bet they could get Lisa Murkowski and Collins, along with maybe Kirk, to vote to confirm.
But then the leadership could turn around and filibuster. So...

(9,951 posts)but it's the Senate that either confirms or rejects the nominee, what are the chances that the nominee will be confirmed?

(1,428 posts)will be voting booth poison. Try a stunt like that and kiss the Senate good bye.
Especially if it's a woman and/or minority.....which it should be.

(15,805 posts)Watching MSNBC interviewing Lindsey Graham who said Obama would have to nominate a conservative to get his vote. He suggests Orrin Hatch. He went on to say, however, that if Hillary Clinton was elected, then he would agree to vote for a liberal justice.
