10th Amendment debate -- to repeal or not?

It Is Time To Repeal the 10TH Amendment And Unify America


It is true that there was open rebellion and massive bloodshed as one faction that could not countenance a 'united' nation sought to rip the country apart, but the sentiment that engendered the Civil War is still alive and well due to one ill-advised amendment to the nation's founding document; the 10th Amendment.

The article makes a compelling case, but I'd rather resurrect mandatory civics classes and teach even the current young generation of conservatives that the 10th was supposed to unite the states, not be used as a weapon against federal civil rights laws.

I realize Repubs are attacking education, especially actual & complete US history, but backlash against the dumbing down has already started -- I don't think yet too late.

There ought to be an amendment that reads like this: No state shall make laws that invalidate, nullify, or otherwise supersede Federal law or hinder the enforcement thereof.

That would explain exactly what states can't do: go over the Federal government's head.

the tenth explains what the FEDERAL gov can't do.....to turn around and make the tenth a declaration of what states cant do would in effect make the tenth the exact opposite of its purpose

The Supreme Court has stated that on several occasions including New York v. United States(1992) and Printz v. United States (1997).
