(10,842 posts)It was not a "toy gun" but a .177cal air rifle which fires pellets at up to 800 feet per second or 548mph.
Air rifles are not sold in the toy dept but in the sporting goods section at Walmart.
They come in sealed boxes.
The gun in question looks enough like a real rifle where if the police showed up you would be smart to drop it as soon as you could.
It's not a gun that would be a good idea to carry around in a public place out of the box. If I bought one at Walmart it would stay in the box and in a shopping cart.

(2,286 posts)But according to the attorney who has seen the video, the pellet gun was unboxed and on a shelf and the victim just picked it up and he says the video shows this. When I first heard this, my first thought was " What did he do?", these things are usually boxed up. I've seen them at my local Wal-Mart
According to the attorney the video leaves no doubt as to whether this was a justified shooting.

(10,842 posts)If you wanted to buy one most people pick one still in the box....and then either go to check out or put it in the basket and continue to shop. The 911 caller said he was "pointing it at children". Don't know if that's true but I think if you don't want to buy one it's way to real a looking gun to carry around till the cops get there. Bad things could happen....and did.
