What is this country coming to when a person can't be minding their own business, just harrassing bicyclists, fighting with cops and then going into a patrol car to grab a gun, without getting shot.
It's just so sad.
It's like we are a police state or something.

That's why I defend cops, because I pay them to protect me from a$$holes like that while I am riding my bicycle.
The rest is just Monday-morning-quarterbacking. Oh, if I was the quarterback, or the cop, I woulda done this or coulda done that.
I tend to give them credit, because they are out there getting slammed to the ground by huge linebackers. Doing a job that I certainly would not want to do.
You know who else had ample opportunity to defuse the situation? The perp.

(3,539 posts)They had ample opportunity to subdue the kid. They let the situation escalate to the point that he tried to grab a weapon from the cruiser. So far as I can see it was three or four against one. They could've tackled him once he was tasered or pepper sprayed. Lets see what the autopsy says. I'm sure they're going to run a tox screen to see what was in his system. Bad police work. We had almost the same thing happen here. The cops are called because a black man is sleeping in a BMW. When the cops get there they ordered him out of the car. There was no response so they smashed the car window and clubbed him with their batons. Turns out the man was diabetic and was having a diabetic episode. The city had to settle out of court for that debacle.

Sometimes the quarterback's job isn't as easy as I think from my position on the couch.
And then if they'd tackled him and he grabbed one of their guns and they shot him, it would be their fault again. Or it would be their fault if they took him down HARD and he got hurt. Guy who is pestering bicyclists and fighting with cops bears NO responsibility. It's all on them to be perfect in dealing with some whack-out dude.
Hindsight is always 20/20.
One obvious thing to me, is why didn't he lock his frigging door?

(1,832 posts)They LET the situation escalate? Yeah the kid needed to lie down and comply. I am half Hispanic and grew up being taught to obey the police or you can get shot. You defend the indefensible and it sickens me. If the kid had listened and complied, we would not be having this discussion. Instead you want to blame the police.

(3,539 posts)people shouldn't get shot if they don't obey the cops. When you as a law enforcement officer have the power over life and death it behooves you to exercise restraint in the use of that power. The video clearly shows the officers using tasers and pepper spray on the victim. If they had done their jobs properly they would've restrained the man and could've cuffed him and put him in the back of a cruiser.
Instead we see a man left to run around for over 5 minutes and the cops chasing after him.
You give credit to police murder.
This isn't about defending someone who was "hailing bicycles" and ended up dead by cops. Although, had he committed a crime, I would support a legal defense for him. This is about a man that is dead who did nothing to deserve to be killed.
Hailing bicycles is not a reason to be killed. Everything after that the cops did to exacerbate and escalate until they shot and killed an unarmed man. Sick shit. And sick that you give that credit. Fuck murdering cops.

should not attempt to steal police cars
Did the video show something different than the article described? (I would not be shocked if that was the case).
And "unarmed"? Somebody in control of an automobile IS armed, with a deadly weapon.

(5,279 posts)that Mr. DAndre Berghardt Jr. grabbed at the AR15 that the officers knew was locked it's holder (and un-removable without the key on the rangers belt). Fearing for their lives pumped multiple rounds in the perpetrator of a moot act.
I feel all saved and shit, how about the rest of DU?

(11,065 posts)Whoever was filming was much too far away to be able to tell what was going on. They complain that the officers "let him get up" but as bad as the video is and how far away it is you can't tell how he was able to get up or if he had a weapon or what. Even whoever took the video aren't complaining that the guy was shot once he dove into the driver's seat of the patrol car but that he believed that the officers somehow allowed the situation to escalate, but they were too far away to be able to see what was happening or why the guy was able to get up off the ground.
Sorry, but once the guy had sole access to the patrol car it's a dangerous situation.... they don't take out the keys in case they have to very quickly jump back in and pursue someone. I don't even think they even turn off the engine for the same reason. I don't know which one fired the shots, but it might have been one of them who didn't know that the weapon the guy allegedly reached for in the patrol car was locked in or not. Weapon in the patrol car or not once he was in the driver's seat he could have used the car as a weapon mowing down whoever he felt like.
Given how hesitant any of the officers were about getting very close to him it's possible that he had a weapon of some kind. There had to be some reason none of them were willing to get at all close to him even when he someone ended up on the ground (given the shitty video I can't tell how he ended up on the ground).
It's a really shitty video, and I really hate it when people that take videos don't bother to even attempt holding the camera still or even pointed at the subject. I got nauseated watching the frame jumping around all over the place the whole time.
Police here are damned if they do and damned if they don't. Had they pounced on the guy to cuff him people would be screaming that he was being beaten up.
