He was already in prison for being convicted of murdering a former wife. The 40 years sentence was added, because he try to have a state attorney killed, in murder for hire, according to Reuters.

I was standing behind 3 other drivers, when I heard a comment from one of them that had me laughing! The comment was "why is Kaine is going be Hillary's VP pick"? He went on to say that "she is a female, a liar, traitor and should be in jail, then finished up that Kaine has no political future with her"! I shook my head in dismay! I said to them "so Trump is not a liar, traitor and a lousy pick for president and why would Pence throw his career away for a fool like Trump"?
