Within the next eight days, the National Labor Relations Board plans to vote on a crucial rule that would speed up union elections—a change that’s drawn serious opposition from the U.S. Chamber of Commerce and Republican politicians. Unions are very eager to see the law passed, since employers will often delay union elections until they can quash the organizing drive through intimidation or other means.

The NLRB only has three of five seats filled because of Republican obstruction in the Senate, and with two of those seats being held by Democrats, passage of the rule would seem likely. But there’s one way Republicans can stop this—and they might be on the brink of doing it.

In 2010, the Supreme Court ruled that the NLRB cannot function with only two members, as it did for a brief period at the end of President Bush’s term and the beginning of President Obama’s. The Court found that two members do not constitute a quorum, and invalidated everything the NLRB did during that time.

So in order to stop the union election rule, which is scheduled to be held by November 30, the lone Republican member can simply resign, and poof—no NLRB. This possibility was first flagged Monday by Mike Elk at In These Times, and today The Hill obtained a letter from NLRB Chairman Mark Pearce to the panel’s only Republican, Brian Hayes. The letter clearly indicates that Hayes has threatened to resign:

“In mid-October, I specifically discussed with you a potential schedule for consideration of the rulemaking. You did not offer any alternative schedule,” Pearce wrote in the letter to Hayes. “Instead, you indicated that, if the board proceeded with consideration of the matter, you would consider resigning your position.”

23. The problem is congress has not been in recess all year.
Whenever they go on vacation they leave one or two members to hold daily one minute "proforma" sessions.

Boeing's expansion to the Palmetto State did not cost a single union job back in Washington state. In fact, Boeing has added 2,000 jobs in Washington since opening its North Charleston facility.

5. I support unions when they are right; however, I always oppose
political gamesmanship and illogical bureaucratic meddling.

At a time when 14 million Americans are out of work, the federal government should be commending this private company for creating jobs--not punishing it.

The NLRB's action defies logic. This one case has the potential to disrupt the creation of more than 11,000 jobs (Boeing estimates 4,000 direct jobs and South Carolina estimates two created indirectly for every direct job) in South Carolina--which could support families and help pay mortgages.

This is bureaucratic meddling, aka government interference in the market. Business are happy to have government intervene on their behalf. Further, since we're on the subject of unions, the various laws on the books that circumscribe strikes represent interference in the labor market.

The piece you are quoting from is clearly (and appropriately) labeled "opinion."

16. I am guessing no unions have ever met your standard of "when they are right".
I know a couple of Boeing machinists. They said the company threatened to move out of the country if they didnt sign a contract that pays all new hire machinists min. wage plus about $2 an hour. Boeing is making huge profits and their employees are being exploited for crap wages. Boeing plays one state off against another, taking advantage of the labor rich market to pay crappy wages. Boeing also doesnt pay taxes. I dont see how they have any morals what so ever. May Boeings fat-cat executives rot forever in hell.

I am glad you decided to grace us with your presence.

The reason the FLRA came into existence was because the NLRB did not serve government workers.

quite a few DUers, including myself. The thing with Roosevelt is extremely familiar, was hashed out by an ex-DUer a while back.

The NLRB has been under-funded since the 1980s. In recent years, workers have been illegally fired in 1 of 4 organization efforts. The caseload is immense and the resources are scarce.
