8. States Define The Two Terms In Various Ways

There is no "one" definition of either "assault" or "battery".

In many states "assault" is the threat of violence and "battery" is a touching to cause offense or injury.

But other states use "assault", and various degrees thereof, for the threat and the touch.

And yes, Kentucky is one of the states which defines various "touching" offenses as degrees of assault.

In Kentucky, first degree assault is:

508.010 Assault in the first degree.
(1) A person is guilty of assault in the first degree when:
(a) He intentionally causes serious physical injury to another person by means of
a deadly weapon or a dangerous instrument; or
(b) Under circumstances manifesting extreme indifference to the value of human
life he wantonly engages in conduct which creates a grave risk of death to
another and thereby causes serious physical injury to another person.

And so on, taking out as one goes down the list: a weapon, the degree of injury, and so forth.

.155 Restraining order upon violation of KRS 508.140 or 508.150.
