Al Gore cleared of sex assault accusations
http://www.kgw.com/news/Portland-detectives-interview-Gore-99180604.html

PORTLAND -- Former Vice President Al Gore has been cleared of any criminal wrongdoing in the case of an alleged sexual assault of a massage therapist in Portland, the Portland Police and Multnomah County District Attorney announced Friday.

Massage therapist Molly Haggerty claims that Gore sexually abused her in 2006.

"The investigative file was reviewed by my senior deputy district attorney in charge of sexual assault prosecution and by one of my chief deputy district attorneys," Multnomah County District Attorney Michael Schrunk said. "They have recommended to me that there be no criminal prosecution and I concur."

30. In the Pacific Northwest the original charges were published
"below the fold" but the news today that Gore was cleared made the headlines. It also was the lead-n to the local TV news. Papers in WA and Oregon told readers in the original reports that the woman had twice before make false allegations. Reports today stress the fact that local papers refused to print her charges until she Enquirer paid for and printed it.

66. Naw, people needed a reason for the divorce, got it, the clearing just becomes controversy.
They have no idea that the very idea of it was ludicrous, that the woman had to read her own prepared statement to the police, and that it is more than like a setup all the way around.

All they do hear is that the charges against Gore are not worth pursuing at every top-of-the-hour newscast. Not even that he is cleared.

Charges were dropped.

Must be some technicality.

(They have no idea, those half-listening voters.)

The dirt sticks.

http://definitions.uslegal.com/d/defamation-and-libel/

Defamation and Libel Law & Legal Definition

Defamation is an act of communication that causes someone to be shamed, ridiculed, held in contempt, lowered in the estimation of the community, or to lose employment status or earnings or otherwise suffer a damaged reputation. Such defamation is couched in 'defamatory language'. Libel and slander are subcategories of defamation. Defamation is primarily covered under state law, but is subject to First Amendment guarantees of free speech. The scope of constitutional protection extends to statements of opinion on matters of public concern that do not contain or imply a provable factual assertion.

Under New Jersey law, defamation is defined as “(1) a defamatory statement of fact; (2) concerning the plaintiff; (3) which was false; (4) which was communicated to a person or persons other than the plaintiff; (5) with actual knowledge that the statement was false or with reckless disregard of the statement's truth or falsity or with negligence in failing to ascertain the truth or falsity; and (6) which caused damage.” Huertas v. United States Dep't of Educ., 2009 U.S. Dist. LEXIS 89903, 17-20 (D.N.J. Sept. 28, 2009)

Libel is published material meeting three conditions:

1. the material is defamatory either on its face or indirectly;
2. the defamatory statement is about someone who is identifiable to one or more persons; and,
3. the material must be distributed to someone other than the offended party; i.e. published, as distinguished from slander.

Same thing happened to Michael Jackson and his name was never cleared. Criminal charges were still filed (no matter what CPS said), he was dragged through a trial and acquitted on all charges due to the fact that there was no evidence against him....and he still was red-lettered, labeled, rubber-stamped.

It is a little odd that gore's police interview was accomplished by having the police submit 14 questions ahead of time to his attorneys.
