Stockton family unwittingly sells house for $6,000


STOCKTON, CA - A family facing eviction after unwittingly selling their home for $6,000 is struggling to restore their name to the title by proving fraud.

According to property records, Emily Emory signed a grant deed in March 2006 giving title of the two-bedroom house at 5276 Dana Avenue to a man named Ebony Corner, who reported the value of the transaction at $6,000 to the San Joaquin County assessor. The deed was notarized by Corner's wife, Nicole.

Emory's daughter Jessica said her mother contacted Corner for a loan on the house and thought she was signing financing documents.

"She got nothing, nothing at all," Jessica Emory said.

Property records show Corner sold the house four months later for $280,000 with a loan from now-defunct Long Beach Mortgage in the amount of $242,000. "It's all fraud. It all shows fraud," Jessica Emory insisted. News10 was unable to locate Ebony and Nicole Corner.

1. Doesn't suprise me.
We're in my old family home and we had a real estate agent show up, a very nice woman really, who explained to me my mother owed 5 thousand on a credit card that had ballooned to 10 k because of penalties and fees and interest, and now the lady woman tells me that Wells Fargo wants the house.

She had no paper work, nothing. Only a card. My mother, now dead nearly 5 years, had great credit and as far as we know she died owing nothing. Needless to say, we're now looking for an estate attorney.

Stuff like this is happening all over Stockton, I've been writing about it here and there. One of the families across the street has been foreclosed on, they owed more than 300 thousand on the house, and the starting bid on it was 56 thousand dollars. How can that be right? The bank won't refinance it for them at 56 thousand, but they'll sell it for that. By the way, no one put in a bid. No one.

5. Ask your attorney about the limitations period.
Most likely on the 5th anniversary of your mother's death any debt she may have owed to a credit card company will be uncollectable, unless they filed suit before that limitations period is up.

3. There's more fraud here than just the rip-off of the Emory family...
I live outside of Stockton, I know that neighborhood, I know property values.

That house, 816 s.f. on a small lot, two bedrooms, wouldn't fetch $40-$50K in this market, and wouldn't likely have hit $75K when things were rosy.

That any bank could file that home at $280,000 is criminal.

That the Emory family gets screwed this way, of course, is beyond criminal.

I feel for them.

I'd like to see long prison sentences for what had to have been a half dozen fuckers, or more, who were involved.

4. Under California law (at least while I was a Notary there), the Notary could be on the hook
for a pretty good chunk of money, or, for that matter, the notarization could easily be deemed invalid by the court.

A Notary can not legally notarize a document they have a material interest in (for instance a property deed involving their spouse).
