The Associated Press
Posted : Friday Mar 26, 2010 19:44:34 EDT

SANTA CLARA, Calif. — A former Army Ranger who says he robbed two pharmacies looking for painkillers to cope with post-traumatic stress disorder will avoid any additional time behind bars.

Capt. Sargent Binkley, who pleaded no contest last year to one count of robbery, was sentenced Friday by a San Mateo County judge to five years of probation. He was given credit for the year he served in jail awaiting trial.

Binkley could have been sentenced to at least 12 years in state prison. He used a gun when he robbed one pharmacy in San Carlos, and one in Mountain View in 2006.

In January 2009, a Santa Clara County jury found him not guilty by reason of insanity in the Mountain View robbery. In that case, he was sent to Atascadero State Hospital for six months of treatment.

COLORADO SPRINGS, Colo. — A Fort Carson sergeant is accused of operating a Ponzi scheme to steal hundreds of thousands of dollars from fellow soldiers.

Prosecutors announced charges against 39-year-old Sgt. Delroy Henry on Friday, saying he allegedly took money from 97 people. Investigators say most of the alleged victims are active military members and served with Henry in Iraq.

Colorado Springs police arrested Henry on March 12 and he is in jail on $50,000 bond. He faces up to 96 years in prison if convicted on several charges of securities fraud, theft and forgery.

Investigators say Henry promised an 18 percent return on investments but instead used money from new customers to pay old ones. Prosecutors say Henry is not a licensed securities broker or investment adviser in Colorado.

FAIRBANKS, Alaska — A former Fort Wainwright soldier has accepted a plea agreement in which he will spend three years in prison for possessing child pornography.

The Fairbanks Daily News-Miner reports 24-year-old Drew Wherry will also receive five years probation and be ordered to register as a sex offender at his formal sentencing June 11.

Investigators say Wherry actively looked for and traded images of child pornography before his arrest in June.

Defense attorney Rex Butler says his client got a general discharge :wtf: from the Army.
