One Lawsuit to Stop Them All
CIVIL COMPLAINT FOR MORTGAGE FRAUD, VIOLATION OF THE FEDERAL HOME OWNERSHIP & EQUITY PROTECTION ACT, VIOLATION OF THE FEDERAL TRUTH IN LENDING ACT, VIOLATIONS OF THE RESPECTIVE STATES' PREDATORY LENDING LAWS, AND VIOLATION OF SECTION 1 AND SECTION 4 OF THE 14TH AMENDMENT OF THE CONSTITUTION OF THE UNITED STATES OF AMERICA.

For those who blame lazy homeowners for the "mortgage crisis"...please glide on by.

For those wishing to understand how Wall Street has defrauded America, I urge you to examine this lawsuit.

Mr. Muckle discovered blatant fraud in his mortgage, identified all of it, including the perpetrators. He has exposed all in this legal masterpiece.

It should be noted that Mr. Muckle, upon revealing this fraud, was offered a "Loan Modification" far beyond his expectations. To his own detriment and for the benefit of all he has steadfastly refused to accept it unless every citizen in his situation is given the same terms.

Mr. Muckle is a carpenter by trade and a brilliant man. It is people like him who will restore integrity and stability to our Country.

It will be fascinating to watch this lawsuit unfold....

We all seem to forget the word “mortgage” derived from French means (“mort” = “death” and “gage” = “gamble”).

Death Gamble.

Usually the borrower dies first and the lender wins the gamble. Once in a while the lenders die en-masse, which without taxpayer support, would be the case here and now. If it’s they who are proved to have committed fraud via bogus Credit Default Swaps, outcome-based appraisals, Yield Spread Premiums, exotic mortgage backed securities, etc….I say let them die.

It would be disastrous for the economy if Americans concluded they were free to walk away from such commitments.

Curious to see if Morgan Stanley get's a 1099-C or deficiency judgement???

More than likely someone will get a nice fat bonus!

with the general sentiment. Lenders DID make this disaster happen by deciding that real estate prices always go up. They DID toss aside their own underwriting guidelines and knowingly enter into bad loans because they could sell or repackage the mortgages and still get them a "Triple-A" rating. They DID look the other way while brokers and perhaps their own loan officers told gullible borrowers they could "refinance" when the interest-only period expired. They DID force otherwise financially sane people to buy into an inflated market because when you're competing with other people getting loans for more than they can afford / more than a house is worth, you don't get a house unless you're willing to pay even more.

I've even fantasized about borrowers finding away to turn the tables and use institutional lenders' abuses defensively in a foreclosure.

But this lawsuit is legal gibberish and will be tossed out of court before the ink is dry.

There may be a way to push back on foreclosures, but this is not it, and pushing this type of thing could discredit a future, more serious effort.

Hi DirkGently, thank you for the reply. Did you notice the part where "they" altered Mr. Muckle's loan documentation to declare his mother as co-signer with an income of 8k per month?

The Federal Judge IS listening and has great respect for Mr. Muckle. There are many ways to combat fraudulent foreclosure. Mr. Muckle's lawsuit is "unorthodox" for sure...let's see what happens.

I know this man personally. Would anyone find it interesting to chat with him?

...Mr Muckle deserves support for putting the interests of ALL ahead of his own.

Hi hootinholler, yes this has been filed Pro Se and under consideration by a panel as we speak. That is why we are desperately trying to get electronic signatures in ALL states.

I am trying to persuade Mr. Muckle to join in on the discussion.

The story is fascinating! Would anyone be interested in discussing this with him?

14. Mr. Muckle would be better served by discussiong this with an attorney. If Mr. Muckle's suit
has real grounds, there's a nice attorney payday with a class action suit.

I truly wish Mr. Muckle the best in his endeavours, but no, I don't care to discuss this with him.

Hi blondeatlast, your advice that I discuss the case with attorneys is very much appreciated, however, I must set that advise aside. The last time I put my trust in an attorney, I receive a 9-12, 9-10, 1, and 1. Those are years; in prison! But I am not angry, because it is where I taught myself the law. It took me four and a half years to do it, but I won the appeal pro se, and overturned the conviction. I won against the State three times because they refuse to let go. By the way, I a not a criminal. What would you do if someone come into your house and try to rob you at gunpoint, while your sister and 10 months old niece is in the house? You would shoot the crackhead if he flinch and give you an opening, right?

I do not need an attorney, you keep waiting for a attorney to help you. all they will do is settle, and a few years from now when everyone think it is peace and safety, it will be a sudden sudden destruction. We cannot fix the problem with settlements and band aids. We demand total reform
