Palin’s Virginia Robocalls May Not Be Legal

Today's Quickie:

Some residents of Virginia have recently received a robo-call from former-Governor Sarah Palin. Mrs. Palin identified herself by name and then entreated the listener to “vote for our shared principles” and to “vote your values.” A recorded male voice then came on the line and informed the listener that the call had been paid for by the Virginia Faith and Freedom Coalition.

But was this call legal?

2. I don't think that any law can really make political robocalls "illegal"
because ultimately there is a question of political speech involved which is protected by the Constitution. It would be bizarre to see a Supreme Court case called "Palin, et.al. v Virginia" but it could well happen if someone decided to prosecute her political robocalls.

We'll have to see.

3. No different then telemarketers not being able to call those on the DNC list.
No different then disclaimers required on campaign material such as yard signs, banners, etc. identifying who paid for the material.

No different then the regulations that candidates must say they approve of the message in their commercials. Or groups supporting or opposing candidates must identify their group.

And there are robocalls that are legal in a state and robocalls that are legal in the same state. The legal ones can use robocalls but a live person must engage the person as an example of a state law. But if the robocall is a completely recorded message in that same state it is illegal.

4. It could be argued that since it wasn't a person making the call
that it is not a violation of free speech. I don't recall anywhere in the Bill of Rights that machines have the right to free speech.
