After googling this everyway that I can think of I find no mention of Temporary Detaining Orders hardly at all let alone in conjunction with background checks for employeement or otherwise.
A brief description of TDO's follows.
Apparently Cho was TDO'ed in 2005. This is, I have had a professional involvement at a distance with this, a means for a court ordered detainment of a person for medical reasons or for psychological reasons. This is fairly standard. It can be issued by a magistrate. TDO's often are for people who may be a danger to themselves (they say the S word-suicide) or to others. A medical TDO is for persons who can't make decisions for themselves and psych TDOs are for people who basically shouldn't. A police officer usually calls in the crisis people from the local CSB who advises a TDO be issued and then the court is contacted.
Even if a TDO was not really need there could be a means to erase it from the records later.
I am amazed that not one state that I can find has a TDO on background checks.
Is it seen as too much of a invasion of privacy?
Would it really dissuade people from calling mental health professionals?
