Why is that asshole still a free man. I read all I could and can not find out why he (and Limbaugh) are still walking around as free men. Is this another example of the double standard? If those of you who are smarter than me, which means just about all of you, can explain please do.

Peace
Max

5. Good old boy Texas justice
If he was black he would have been sitting on death row already.

But he served his masters well by redistricting the state illegally, so he will likely never pay for his misdeeds.

11. Issues are still on appeal
First DeLay appealled some rulings and lost on most of his claims and then his co-defendants appealed a different set of rulings. I do not think that the case has been dismissed. One of the rulings is a dicta ruling that one of the statutes only applies to bribes paid in cash and not to bribes paid by check. That ruling was obner dictum and so there is no way to appeal it but may slow down the eventual trial.

Remember the republicans still control the Austin state court of appeals and the Texas Ct. of Criminal Appeals.

12. Delay is a Republican. He is above the rules ordinary citizens have to follow
Besides, the 'Pukes want to run him for office again in a few years, so they don't want him tarnished by spending time in prison

14. Well, DUH!
If he's in JAIL, he can't appear on HARDBALL every 90 days, and have Chris tell him "what a pleasure it is to have him on"

Delay is a VILE creature, and now we get to hear Alex Witt and Tony Harris tell us HOW WONDERFUL he is, until "Dancing" bounces his bug killing ass.

Who ever said that we are the "least informed, and most entertained country on the planet" nailed it.

15. He's not in jail because
because he hasn't been found guilty of anything.

When he was first indicted he accused the prosecutor of a political indictment and demanded a speedy trial so he could keep his leadership role as the repoublicans in congress have a rule that indicted members must step down from leadership.

The prosecution kept asking for delays, and now five years later things have reversed and the trial is being held up by Delay's appeals.

The prosecutor has since retired.

I used to pay pretty close attention to this, but I've lost contact. Is there a trial even scheduled?

It isn't fair to anyone to indict someone and then not try him for five years. There should be some limitation because I don't know what a "speedy trial," is, but it sure isn't five years.

To me the worst abuse of the "speedy trial" provision was the non-trial of Jefferson Davis, who was indicted, demanded a speedy trial, and then was never tried but left indicted.
