DNA Frees Accused Killer, Rapist After 21 Years

You can take the handcuffs off, Judge Richard Damiani said. And with that, a man who has been in jail for 21 years and was supposed to spend decades more behind bars walked away a free man.

DNA set him free.

The dramatic release took place Wednesday morning in Connecticut Superior Court on Church Street.

Kenneth Ireland went to jail in 1988, at the age of 20, convicted of raping and killing a woman named Barbara Pelkey of Wallingford. The sentence: 50 years.

His case was taken up by the Connecticut Innocence Project, which uses DNA evidence from crimes to prove that people have been wrongfully accused. They did that in this case to buttress Irelands longstanding claim that someone else, not he, committed Pelkeys rape and murder. The Project petitioned for a new trial, and the petition was granted.

Damiani ordered Ireland released Wednesday on a promise to appear. He technically faces a new trial, though its unclear whether one will take place. His next court appearance is Aug. 19.

1. The judge, prosecutor, witnesses and jury that convicted him...
...have also remained at large for two decades.

2. Tis was all over Connecticut public radio yesterday, and...
last I heard, the prosecutor is not going for a retrial.

Aside from this poor guy spending half his life in the slam for something he didn't do, the real killer may still be out there, and this is now the coldest of cold cases.

4. ANY case that has dna evidence that could exonerate someone who's been convicted should be tested.
and states should NOT be able to fight it if the convict wants it tested, either.

6. Now, if he had been executed he never would have gotten out.
But now a convicted killer/rapist is free thanks to soft-on-crime bleeding hearts. </freepermind>
