Barr helped write the federal law governing death-penalty appeals when he was a member of Congress. He recently wrote that the Supreme Court should grant Davis an "original writ of habeas corpus" and order a federal trial court to hear from witnesses in the case - most of whom have recanted or changed their original testimony.

In a column published last week by The New York Times, Barr said the courts "misread" the Anti-Terrorism and Effective Death Penalty Act.

As a member of the U.S. House of Representatives, Barr - a former federal prosecutor - helped craft the act. It was intended, Barr wrote in the Times, "to stop the unfounded and abusive delays in capital cases that tend to undermine our criminal justice system." He added, however, that "nothing in the statute should have left the courts with the impression that they were barred from hearing claims of actual innocence like Troy Davis'."

But even jurors' unanimity does not guarantee justice. The death penalty is arbitrary and capricious, subject to common prejudices and casual errors, influenced by race and class, gender and geography. Those are among the reasons that the U.S. Supreme Court should give Troy Davis, sentenced to death for the August 1989 murder of Savannah police officer Mark Allen MacPhail, the chance to be heard in federal court.

Since the trial, several key witnesses have recanted or contradicted their testimony, claiming they were pressured by the police to implicate Davis or intimidated by another man who may be guilty of the crime. Most chilling is the recollection of Tonya Johnson, who says she didn't tell police all she knew back then. She now says that she saw a man running from the direction of the shooting that night and that she saw him hide two guns behind the screen door of an abandoned apartment next door.

According to Davis' attorneys, that man was Nathaniel Sylvester Coles, a small-time thug whom they believe Johnson feared too much to tell the truth. It was Coles who first fingered Davis, coolly strolling into a police station hours after the murder, accompanied by a lawyer, to identify Davis as the shooter. And it was atop that dubious testimony that police mounted their case.

It's now apparent that case deserves more thorough review. In May, 27 former jurists and federal prosecutors filed a petition asking the nation's highest court to send the case back to a lower court, where Davis can show "new, never reviewed evidence that strongly points to his innocence." The former prosecutors include Republicans Bob Barr and Larry Thompson, who also served as a deputy attorney general in the administration of George W. Bush.

1. Typical Republican. Doesn't understand anything until an actual case is pushed in his face.
No intellectual understanding of anything, no empathy...until they get up and close to an actual instance of something, they don't imagine it exists. The same holds true for things like product defects, racism, etc.

2. Current SCOTUS is hostile to claims of innocence
Even the more liberal members are careful about that for legal reasons; they don't think SCOTUS is capable of doing findings of fact like that, and tend to remand them to lower courts.

This is about Troy as much as about our judicial system. There must be hundreds or even thousands of people in our prison system who we are not certain belong there.

yes, so many more who don't belong in our prison industry. no time to even breathe on one case, then along comes next wrongful prosecution, threat of execution....
Troy's case is beyond what people believe....
but then, look now at the case of Reggie Clemons, an African American man, St. Louis, Missouri.... "no physical evidence linking Reggie to the crime: no fingerprints, no DNA, no hair or fiber samples; nonetheless, Clemons was convicted and is scheduled to be executed on June 17 of this year."

and i grow dizzy. again.

they have pitted cases against each other this way, before. and so often around when Troy's case is on alert......


yes yes yes, it is, yes, about our judicial system, and it must change. must absolutely must.

NAACP, Ben Jealous, in fact, said that this summer NAACP launches reform.....

The NAACP is launching a campaign called “I AM TROY” to save the life of Troy Davis, an innocent African American man on death row, who will be executed unless Georgia Governor Sonny Perdue or the Savannah District Attorney Larry Chisolm intervene. The NAACP is calling on people to get involved and contact Governor Perdue or Savannah District Attorney Chisolm urging them to not allow the execution of an innocent man.

Davis is also being denied the right to speak to the media. 60 Minutes, Dateline, and other television programs are being denied access to interview him. While the prison will allow Troy to speak on the phone to reporters, “The denial of his right to speak to television is a flagrant abuse of his First Amendment rights”, says Jealous.

“It not only is morally wrong to put an innocent man to death, it does not bring justice to the victim’s family and allows a dangerous criminal to go free. We have witnessed scores of people wrongfully sentenced to death in our nation. Justice requires we not turn a blind eye to killing another innocent man – a travesty that can never be rectified.” Jealous said.

The NAACP will unveil a national campaign at its Centennial Convention July 11-16 in New York aimed towards reversing those trends. The campaign’s overarching goals are to make communities safer, improve police performance, save money and end the mass incarceration that characterizes our country’s criminal justice system. The bid to that court has to be considered a long shot for Davis: The nation's highest court has seen this movie before. But the ability of Davis' backers to keep the case tied up in the courts as the calendar turned over from 2008 to 2009 may end up being the most important thing that they did since Davis was convicted and sentenced to death in 1991.

That's because when court started back up after the New Year's holiday, the Chatham County district attorney's office had a new lawyer at the helm. Deciding 28 years in the job was enough, Lawton didn't seek re-election. His chief assistant, David T. Lock, who had worked with Lawton on Davis' case, tried to win election to the top job. But the winner of a contested Democratic primary got in his way. Larry Chisolm, a quiet former assistant DA who had left the office a few years before, won the election, with a little more than 54 percent of the vote.

G. Terry Jackson, another criminal defense lawyer in Savannah, says some may have interpreted Chisolm's campaign talk about taking a fresh look at things to mean that he was going to review old cases. But Jackson says he doesn't think that's what the candidate meant.

Dear All,
The Georgia Fraternal Order of Police (FOP) are in Savannah now for their annual meeting at the Marriott Savannah Riverfront Hotel. They have dedicated their meeting to Officer MacPhail and are urging DA Chisolm to let the execution go forward ASAP!

We need to ramp up our efforts. If you have not sent your personal letter to Chisolm, et. al , yet, please do so ASAP! By all means, yes, you should also sign all the petitions available at NAACP, et al (see http://freetroydavis.com/chisolm_reopen.aspx and www.iamtroy.com)

BUT don’t stop there - you really need to reach out to Chisolm personally and directly with the message that Troy’s innocence matters. If Chisolm has to choose between members of the police and members of amnesty or other anti-death penalty groups – I think we all know he’s going with the police. The only voice more important than the police is yours! Why? Because you’re a voter – because you know voters in Savannah - because you can (and will) campaign for or against him depending on what he does – because you can (and will) use every means available to see that Chisolm gets what he has coming to him.

Used your own words and sentiments to convey why it is critical for him to investigate Troy’s claim of innocence. Send it directly to him (see www.freetroydavis.com for contact info) – don’t just leave it up to NAACP, AI, GFADP, CEDP, or whoever to send your message.

Georgia State Lodge Fraternal Order of Police held its annual conference here in Savannah, and today they dedicated the conference to the late officer, Mark MacPhail Sr.

Troy Anthony Davis was convicted and sent death row in 1991.

He's still there, appealing his conviction and hoping for a new trial.

this is much better, and understandable.
Ms. Kelley has gone pretty far to be fair in this and other articles. i have lately been trying to underline the FACT that Justice for Troy IS Justice for the MacPhails. That as a police officer, Mark MacPhail would surely have expected the courts to make sure they have the right man imprisoned, sentenced for any murder. as must the family.
