The practical reality is she's going to be confirmed, and probably rather easily.

Even Sessions has more or less conceded there's not going to be a filibuster.

The campaign against her has not come, for the most part, from elected or Senate Republicans, where the matter will be decided, but from the various GOP propaganda artists, whether it's Newt, Glenn Beck, Limbaugh or whoever.

What's most unbelievable is that these propagandists are attacking her directly with the racial angle, calling her a racist and a reverse racist, calling La Raza a Latino KKK etc., which might help fire up knuckle dragging base GOP voters who will dislike her or be suspicious of her based on race alone, but it's the one angle GUARANTEED to hurt the party as a whole with Hispanic voters.

I mean, what the FUCK, GOP? You could have come up with some kind of trumped up opposition research crap to oppose her on, winked at your knuckle draggers who would get the message, and not thrown gasoline directly on the fire.

But you had to go there, didn't you? You had to go right there.

There doesn't appear to be any strategy to any of this, it doesn't make ANY kind of rational sense even from the viewpoint of trying to get back into power. They seem to do all this just on instinct. They are the drunken right winger who has to pick a fight on politics at the family barbecue when everyone's having a good time, and piss everyone off.

2. A major difference.
The non-elected talking heads from the far right are marginalizing themselves and their toadies more and more these days. Intelligent GOP office-holders are beginning to get it that they need to put as much distance between themselves and the wingnuts as possible.

To that end, the clever ones are keeping their mouths shut. The idiots? Well, they're idiots. Note that most of the loudest voices hold no office at all. They are powerless, so they bray all the louder.

Screw 'em!

3. I think you've pin-pointed it
The division appears to be between elected Republicans who have something to lose by being ignorant assholes, and non-elected bomb-throwers who have nothing to lose. It's instructive to me that Rush Limbaugh is taking the time to excoriate the folks on his side of the aisle.

ABC helpfully provided footage this week of Rush intoning on his radio show that Republicans are just supposed to "acquiessssssce" to Sotomayor's appointment. Rush is clearly not happy with the rump Republicans who still hold office for not continuing the politics of party destruction that put them in the fix they're in now. But isn't it nice of ABC to air footage of Rush? I mean, the man's so marginalized and can't get his own opinion heard anywhere, so giving him free national exposure just seems like, I dunno, a public service or something.
