FORT WORTH — A Fort Worth man who killed his wife's lover after finding them together has escaped murder charges from a grand jury.

Instead, the Tarrant County grand jury indicted Darrell Roberson's wife, Tracy Roberson, accusing her of causing the shooting by claiming she was being raped.

The 35-year-old wife is charged with manslaughter in the death of Devin LaSalle. Police say Roberson invited LaSalle to her home in December with a text message that said "I need to feel your warm embrace!"

Prosecutors say Darrell Roberson arrived home and found his wife—clad in only a robe and underwear—with LaSalle outside in a pickup truck. They allege Mrs. Roberson told her 38-year-old husband she was being raped, so he fired four shots as LaSalle tried driving away. One bullet struck LaSalle in the head.

Story from December says police have 911 tape saying different. Don't know if it came out or if it does say different.

One bullet hit Mr. LaSalle in the head. He was pronounced dead at 2:40 a.m. in front of the Robersons' house. Mrs. Roberson tried to tell her husband that she was being raped, but he didn't believe her story, according to a recording of the 911 call that police have not released.

4. I have a simpler fix:
Men should avoid, at all costs, romantic and sexual entanglements with married women. Especially if they are married to someone else.

Nothing good ever comes from these entanglements. Nothing. The situation above couldn't make that clearer.

Murder can be accomplished with many weapons, even your bare hands.

20. I am neither trying to absolve guns...
or blame women. That said, at the simplest level, messing with married women is a Very Bad Thing. Nothing good ever comes of it.

9. The husband was stopping a rapist from escaping
Or at least he believed he was, according to the story. The police homicide unit and the grand jury had over three months to process this.

A rapist who, he would have to believe, broke into people's homes and raped them. Perhaps killed them, to leave no witnesses. Probably a serial rapist, at that, as violent rape of strangers is not usually a stand-alone attack.

And the father had three young children in the house as well.

If the husband was operating under that information, true or false, then he was acting in a manner that protected society from those that prey upon the innocent.

This would be one of those 'justifiable homicides', even if the guy was wrong. If the guy was wrong, it is because his wife lied to him, and she is responsible for the lover's death, not the husband.

So if this is true, the husband never killed the man because he believed his wife was being raped, and therefore, why is she being charged with manslaughter, if the cry rape (a horrible thing), didn't enter into it?

It sounds from this, that the state of Texas wants to brand a big scarlet letter on her.

19. Can't Find the Transcript, But Here's an Account of the Affadavit
When Roberson spotted his wife and LaSalle, he pulled directly in front of LaSalle's truck and demanded that he get out of the vehicle, the affidavit said. Tracy Roberson was still in the pickup with LaSalle when he was shot while trying to drive away, according to the affidavit.

According to the affidavit, when Tracy Roberson got out of the truck, she and her husband called 911 and Darrell Roberson said, "I can't believe you're on me."

Darrell Roberson did not believe that his wife was being raped, according to the affidavit.

If I'm reading this right, the affidavit mentions statement made by the wife who is trying to deflect her charges to her husband. She can then walk and her husband goes to jail. Is this correct?

I read the December version of the story (linked above):

After her husband left, Mrs. Roberson sent Mr. LaSalle a text message: "Hi friend, come see me please! I need to feel your warm embrace. If ur unable too I completely understand!!!"

Mr. LaSalle drove to her home in his Chevrolet Silverado pickup. When he knocked on the door, Mrs. Roberson answered wearing only underwear and a robe.

The couple went to Mr. LaSalle's truck, parked in front of the house.

While they were in the car, Mr. Roberson called home repeatedly but got no answer. Police determined that he called his wife 19 times between 1:33 and 2:12 a.m. Finally, his 7-year-old daughter answered.

The girl searched the home but couldn't find Mrs. Roberson. She told her father that she had heard a knock on the door earlier and thought her mother was still outside.

Mr. Roberson drove home to Arlington and shined his high beams on the Silverado. Police said he saw Mr. LaSalle kissing Mrs. Roberson's chest as the couple sat in the truck.

Mr. Roberson approached with a handgun and yelled at his wife to "get your out of the car." Mr. LaSalle tried to speed away – he hit the accelerator hard enough to leave tire marks on the pavement – and Mr. Roberson fired four shots into the truck, police said.

One bullet hit Mr. LaSalle in the head. He was pronounced dead at 2:40 a.m. in front of the Robersons' house. Mrs. Roberson tried to tell her husband that she was being raped, but he didn't believe her story, according to a recording of the 911 call that police have not released.

Lt. Miller said it's not clear whether any of the shots were intended for Mrs. Roberson. She told detectives that her husband was shooting at the truck "to hurt whomever."


Something tells me that he didn't believe that lie in the first place.

So she has her boyfriend come over at 1:30 in the morning and goes out into the driveway to have sex with him in his truck while her kids are in the house.

Her boyfriend dead.
If that is the case, her lie does not matter. Her husband didn't shoot the man for that reason. She may have lied because of the shock of the whole situation and fear that he would shoot her next.
If she was screaming from the truck "Help, I'm being raped" before he shot there might be a case if it was shown that her husband actually believed her.
With how the article is presented though, it doesn't seem like they have a case against her and there is no reason that her husband wasn't brought to trial.
