Rove lawyer out of office until deposition date

House Judiciary Chairman John Conyers, Jr. D-MI) has subpoenaed Karl Rove a third time, asking him to appear Monday, Feb. 23 for a deposition to testify about his knowledge about the US Attorney firings and the alleged political prosecution of former Alabama Gov. Don Siegelman.

"Pursuant to my letter to you of Jan. 29, 2009, and your agreement to accept service on behalf of Karl Rove, I am enclosing a subpoena for Mr. Rove to appear and provide testimony by deposition on Feb. 23, 2009, at 10:00am in room 2138 of the Rayburn House Office Building," Conyers wrote Robert Luskin, Rove's D.C. Attorney.

An email message to Luskin from Raw Story was returned with an auto-reply.

"I will be out of the office and unable to check emails or voicemails until February 23, 2009," the reply said. "If you need immediate assistance, please contact my assistant."

Neither xCommander AWOL Bush nor VP Dickie 'Five Military Deferments' Cheney are around to save him, and by now Rush 'Draft-dodging-drug-abusing' Limbaugh has about ZERO power over anyone other than the pathetic handful of Republicon Chickenhawks who worship and obey him.

So, this time the HAMMER of American justice is coming down on Chickenhawk Homelander Rove.

7. U.S. Constitution, Article II, Section 1:
The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows. . . . .

As of noon on January 20, 2009, the executive power is invested in President Barack Obama.

That means that Mr. George W. Bush has no executive power, and therefore no power to invoke the executive privilege. That means Mr. Karl Rove can no longer invoke the executive privilege based on instructions from his former boss, Mr. Bush.

Mr. Rove now has two choices: 1) answer the questions of Congress; 2) take the Fifth Amendment.

Assuming that, in the past, Mr. Rove did have the right to refuse to answer specific questions based on executive privilege, his lawyer should have told him that he was obligated to appear and invoke his privilege in Congress.

Mr. Rove's arrogance will get him in trouble.

27. only problem with that is...
he can **claim** executive privalege, even if he doesn't have it, which would send it to the courts which could end up in the supreme court which is stacked for rove.

Just how much contempt can a guy pile up? Does the contempt get any worse after the third time? Will Conyers put the next subpoena on red paper with exclamation points and underscores, and enclose 27 8x10 color glossy photographs with circles and arrows?

Unless Rove can call on (current) minions of our government to protect him from this subpoena, the Conyers should simple do what normally is done with folks who won't show up where they are (legally) requested to be. Hire Bounty Hunters to bring him in.

Throw him in front of the Committee in chains, let him testify, and then unlock him and then let him go. At least until we get the goods to issue a warrant for his his arrest.

Seriously. Who says Conyers cannot do such a thing ?? And, if he can, why should he not, given Rove's intransigence?

38. Howdy !
It's been quite a ride.

I was convicted in Municipal Court (as I was told would be the case) in October. I appealed to circuit court and have been granted a new trial (de novo) which is scheduled for April 6, 2009, when my new attorney is planning a full scale jury trial. The new guy, Brett Shirk, is the past ACLU head in Western Missouri-Kansas District, so I am feeling real good about that part of it. Prior to obtaining his services, the cost of doing a jury trial would have been prohibitive.

On the political front, the GOP Election Director (Charlene Davis) who had been behind it all, resigned effective 1/6/2009. The commissioners replaced her with a previous board member (Tammy Brown,) in attempt to place her permanently, before Jay Nixon, our new governor, could e sworn in and name his own replacements. Checking on things in Jefferson City, earlier this week, I find that the Governor's office became aware of things and has made all of it "provisional".

Good news is that in St. Louis County (the other big area of GOP infiltration), the Governor has already appointed a Commissioner who is reliable and trustworthy. I expect the same will occur very soon in Jackson County.

The retirement of Charlene Davis was already expected, however. The appointment (or attempt at it) of Tammy Brown was not expected, and it is good to have put a short life to it, as Tammy Brown was the person placed (as we found out) who was tasked by the national GOP to break the story of the ACORN "Voter Fraud story". And, perhaps, that was the reason for my rather unlikely arrest, as there had to have been some legitimate motive for their decision to take that course of action in August.

At any rate, the attorney and I have agree that we will soon open the subject of the trial, etc., here on DU, let everyone pay catch up on the information, and then have them weigh in with opinions, thoughts, etc., about the issue and how to best turn it to the advantage of the voting public.

I look forward to April in reference to your appeal. I'm sure you'll be victorious. Best not to talk about the case on line though...being a Jury trial and all and how things get misconstrued.

ER's been pretty quiet, with the exception of the Connell's plane going down, a bit freaky that.

White House counsel Gregory Craig issued a statement late Friday encouraging former Deputy White House Chief of Staff Karl Rove to cut a deal with Congress, an indication the new administration has begun to put pressure on President George W. Bush's former chief adviser.

"The president is very sympathetic to those who want to find out what happened," Obama's White House counsel Gregory Craig said in a statement yesterday to The Washington Post's Carrie Johnson. "But he is also mindful as president of the United States not to do anything that would undermine or weaken the institution of the presidency. So, for that reason, he is urging both sides of this to settle."

Moreover, the Obama White House is now trying to work out an agreement with former Bush administration staff -- seemingly going over the head of the man some once dubbed "Bush's brain."

Craig's statement does, however, seem to suggest that Bush's former adviser will be granted some leeway as to the form of his deposition to Congress in lieu of President George W. Bush's claim that Rove is protected by executive privilege.


To "Leeway"or not to "Leeway"... if he co-operates he may get "Leeway"
