US court rules against dying woman on medical marijuana
San Francisco- A US federal appeals court on Wednesday
ruled that a fatally ill California woman could be prosecuted for
using medical marijuana that her doctor says is the only thing
keeping her alive.
The ruling against cancer patient Angel Raich by the Ninth
District Court of Appeals highlighted the dichotomy between
California state law, which permits the use of marijuana for medical
purposes, and federal law set in Washington that bans it.

Raich had proactively petitioned the court to issue a ruling on
whether she could be arrested for drug use. Suffering from scoliosis,
a brain tumour, chronic nausea and other ailments she eats or smokes
marijuana every couple of hours on doctor's orders to ease her pain
and bolster her appetite.

The case centred on Raich's right to use marijuana to keep her
alive when legal drugs fail, but the three-judge appeals panel ruled
the US has not reached the point where "the right to use medical
marijuana is 'fundamental' and 'implicit in the concept of ordered
liberty.'"

1. Wow.

No right to life? This is esentially what they are saying:

the US has ruled that, owing to the huge amounts of money we make off of Pharm Companies, we have not reached the point where your RIGHT TO LIVE is supported. We like $$$$$ more than you, Dying Lady.

Sorry. But money talks and bullshit walks. Have a nice day!

This chaps my ass. What a bunch of heartless, greedy scumsucking pigs. There is no sane, logical or legal basis for this decision. The only thing that explains it is something Jesus warned against:

GREEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEED

Moral people, my ass.

2. This will be so challenged.
Maybe the tide will turn, and challenge will buttress the push toward some sane legalization that everyone can live with.

3. Yep, the German Press Agency article goes on to mention a SCOTUS appeal,
and fortunately, she lives in CA...we have a State law that runs counter to the Federal stand on the issue. Kudos to her for being willing to take it up the judicial ladder.

4. John Ashcroft and Bush said this was against their sense
of religion and personal morality. I guess that's what they are sticking with.

5. they don't care about us
if a sick woman needs a drug that might cheapen the value of "their" drugs, then by god the sick woman should just shut the fuck up and die

that is the attitude of the rich today, we are just cows to be farmed, and once we are sick and of no value, we need to stfu and die

it's too bad we can't all have a fund-raiser and mail this woman to amsterdam

6. Apparently the members of the Ninth District Court of Appeals want Angel Raich to die a slow,
painful death.

They will be guilty of torture and pre-meditated murder.

9. The good news
.... is that local agencies in California don't bother medical marijuana patients generally. However, every once in a while the Feds get a bug up their butt and raid the dispensaries just cuz they can.

10. I'll say it again, since the federal courts have repeatedly given the finger to citizens on this:
WE CONTROL THE CONGRESS. Another way to rectify this situation is to change Federal Law.

Time for our party to grow a pair on this issue.
