"But in a 9-0 judgment, the high court found the system violates the Charter of Rights and Freedom. It suspended the judgment from taking effect for a year, to give Parliament time to rewrite the part of the Immigration and Refugee Protection Act that deals with the certificates."

Better late than never I don't know why it will take a year to rewrite the act though.

2. Canada's constitution doesn't function like the US one
Edited on Fri Feb-23-07 11:05 AM by cgrindley
Canadian rights are not guaranteed by the constitution, not absolutely. The government can over-rule the constitution claiming that a particular "right" may be temporarily or permanently suspended for the good of everyone. This is just the court's way of slapping it back without provoking a fight. By the time the law actually expires, it will be long gone. Almost like it never happened.

ed for grammar
