I'm not convinced Bush will let go of power, especially if he fears prosecution - staying in power is the safest way for him to avoid accountability for his crimes, and I don't underestimate him in this whatsoever. And don't tell me the Constitution won't let him stay in power indefinitely - the Constitution hasn't stopped him yet...
