Mutts & Moms suspended in 2006; Ellen / Iggy contract may be void
According to the California Secretary of State’s Web site, the Mutts & Moms corporation has been suspended since December 2006, when they failed to file a “statement of information.”
...
As a result of the suspension, enforcing the contract with Ellen and Portia may be impossible for the agency, as both the original adoption of Iggy and the date the agency reclaimed possession of the pet happened after the suspension began.

1. So they've destroyed themselves with their intransigence.
Because nobody would of known about this otherwise. Now they look dishonest and disreputable.

4. Geez, I suppose they'll have to stop rescuing and saving dogs now.
Enough bullshit, already. Ellen, get a life. The dog is with a new family. Use your wealth and resources to assist organizations that protect and save animals, not squash one that has probably saved tens if not hundreds of abandoned, homeless animals.


If the contract is void, then the Ellen's adoption would also be void. Sh*t, go on petfinder.com and LOOK at all theanimals who are hours away from death! (those marked "Urgent") This is such bulshit.

7. Spot on-- like I've said elsewhere, the story...
is becoming about poor Ellen, and not about the dog.

Gawd, I hate whiners, and she's becoming one of the biggest.

9. I just put in an inquiry on a cat marked "urgent" to an animal rescue group

I don't even know if she's been euthanized, because the date was a few weeks ago (but she was still on the site). I am not sure if my husband will be on board for another cat, but one step at a time...

The people that do animal rescue work are ANGELS, not lawyers, and they do the most stressful, heartwrenching work... the protection of the dog/ cat is their only interest not the FEELINGS of celebrities... these are people who know well the ugly side of human nature, that can abandon, neglect or abuse an animal- each pet has a story, most very very disturbing. I've adopted 4 cats so far (at different times) from shelter and animal rescue groups, and it is heartbreaking to see how the animals got there. That she would ever threaten, try to intimidate or interfere with the operations of such an organization is revolting. She really needs to use her $$$ for good works that expand services for these poor animals, not stop them.

8. I'd like to know why Ellen's hairdresser is more entitled to Iggy than his new owners.
Let's get a dog psychologist over to Iggy's new home to evaluate his current owners' "parenting" skills. Then take Iggy over to the hairdresser's daughter and see if he is so hopelessly bonded to her that nobody else could ever, ever take proper care of him.

This whole fiasco seems like just another diversionary attempt by MSM to get our minds off the * disaster. Another one which played all day yesterday was a story about a dancing parrot. Yes, the video of a dancing parrot played over and over on CNN. I thought I was watching America's Funniest Animal Home Videos (except it wasn't that funny). CNN, the "best news network" indeed.

5. I'd like to see more regulation of "rescue groups" now that I've learned more.
I was VERY shocked to see quite a few people/groups claiming to be rescue agecies charged with animal abuse:

Authorities said they've filed felony animal cruelty charges against a Blount County woman after 60 dogs at her kennel - many of them sick, malnourished or injured - had to be euthanized this week.

Ten counts of first-degree cruelty to a dog or cat were filed against 62-year-old Anelia Smith, said Blount County District Attorney Tommy Rountree.

Smith is operator of the Anelia Animal Sanctuary Inc., on Ebell Road west of Oneonta. She was arrested on May 31, charged with misdemeanor cruelty to animals and released from the Blount County Jail on $1,000 bond.

12. I could only read a few of the cases on those pages - they were too sad.
And what made them even more sad for me is that I do believe at least some were the results of well intentioned people.

10. The status of the corporate entity appears moot to the real issue!
Cops have no right to interpret and / or enforce written contracts between differing parties!

Guilty or Not of entity misrepresentation ( this is usually resolved by paying a fee ), this case should have never been handled in this manner. Had it been handled properly, there would not have been this firestorm of controversary over who is responsible!

Once possession has been transferred, breach of a contract is determined in a court of law, not by cops on the beat, or, from the heat on the street!

The mutt got screwed, Ellen got screwed, and the kid(s) got screwed. Our judicial system just seems to be filling up with illegal, and un-necessary "what-if" prosecutions; a lot of which unfortunately evolve from legally un-enforceable contract language written to satisfy personal wishes, which in fact are in direct contradiction with the laws of the land. It seems that many business owners think that just because they want it a certain way, that it is enforceable if someone agrees to it... NOT! Contract language must be enforceable, and therefore must be shown to be reasonable and within the purview of the courts. I want to say that over 90% of the online contracts I've seen written by amateurs ( most on eBay ) are unenforceable under the state laws in which they would apply.

Example, many eBay sellers, and other similar small business owners, like to include a variety of legally contradictory statements in their conditions of sale like " Once the item is shipped, it is out of my control, therefore I will not be responsible for lost, broken, or undeliverable items." In fact, all state consumer protection laws REQUIRE the seller to deliver the product in the condition in which it was advertised when sold, in order to consumate the transaction.. In other words, a seller can not simply absolve themselves of the liability to deliver the product, simply by making a statement to that effect! Similarly, when one is in breach of contract, it becomes a matter for the courts, not the police!

I think Ellen has a case against the Muttering Mom, and should go for the jugular! Make her bleed the green blood. That seems to be the only type of blood letting business owners have come to understand..

Where will it all end! I suggest a Revolution against petty prosecutions!
