Robbery suspect accused of murder
15 year old unarmed burglar in Louisville charged with murder (as an adult) after his armed accomplice was shot and killed by the victim of their burglary.

1. So if I am reading this correctly the accomplice that was shot
and killed...willfully did not make a decision to join the other criminal to commit a crime...and wait he is the one that had a gun...

Of course the homeowner shouldn't be charged he was defending his home and his life.

The kid should be prosecuted by not for murder he did not kill the kid. Burglary yes.....an accomplice yes...murder????

2. Felony Murder Rule
At common law, and I believe in all the American states, a death that results from the commission of a felony comes under the "felony murder" rule.

I.E., the felon is subject to prosecution for MURDER 1 -- premeditated murder.

I always thought the rule was harsh, but it's been the rule for at least 200 years.
