On Friday, the White House requested a second extension to the deadline to comply with subpoenas issued about the origins of the warrantless surveillance program. Senate Judiciary Committee Chairman Patrick Leahy's (D-VT) response? "The deadline is 2:30," says Leahy spokeswoman Erica Chabot.

The original compliance deadline was July 18, but the committee and the White House agreed to an extension after Fielding and chief of staff Josh Bolten called Leahy to say that "thorough collection and review of responsive documents" would take until around August 1. After another week lapsed beyond that, on August 8, Leahy told the White House that August 20 -- today -- is the final deadline.

Leahy flew into Washington earlier this morning, and at 2:30 p.m. will make his way to the judiciary committee's hearing room in room 226 of the Dirksen building for some further response. Whether the White House turns over the documents, reiterates its request for more time, or formally claims executive privilege to contest the subpoena, "we'll have to wait and see," she says. Leahy has not heard anything from the White House since the Friday letter from Fielding.

This afternoon, the next steps for all sides should be clearer -- particularly whether, in the event of noncompliance, Leahy will seek to have the committee consider members of the administration formally in contempt of Congress.

He's spending 2 days at a fabulous resort hotel in Montebello CA. ( east of Ottawa, North west of Montreal) with Harper & Calderon, discussing how he can enrich our lives with improved trade regulations among the 3 countries.sarcasm
That's why I am going to have to spend $116.00, I can't afford, for a passport so I can drive to Canada to save $25. on my monthly coffee purchase!
The $ store which used to be the .66c store, till ghas more useful things...even if the exchange rate is now even! All they sell in the American $ stores is gift wrap cards, ballons party hats.
Have you noticed that? It's "Go shopping, and when you're done throw a party, support this war!

I'm tired of all the muscle flexing, though. They get all worked up for a battle, and then POOF! nothing happens. It's almost as if someone turned off a switch.

Whatever happened to Condi Rice's subpoena that she ignored?

How about all the other subpoenas that have been issued, but ignored?

Really, enough is enough. This flexing without follow through is just making a mockery of our legal system (what little is still intact), and of Congress.

A "centrist" DEM once told me that someone took a poll once and found out that voters don't like "negative", "aggressive" politicians. They just vote for them.

We discuss, then we contemplate, then we agree to "work with" the liars and criminals. That's how it is and that is how it will be.

It's a proven "strategy." Not proven to WIN, mind you, but proven none-the-less. It worked in 2006- just look at all the power we now have as a result.

And I agree that many (most?) of those DLC types, in the words of TR, "have the backbone of a chocolate eclair". But I don't think that characterizes people such as Leahy --- or Conyers or Waxman, or several others I could name --- PARTICULARLY Leahy!

I haven't watched TV for over a decade, and I'm not likely to start now. But I'll be following this on the internet through the day, and with HOPE in my heart!

Perhaps some of the Virginia and Maryland Senators will show up, but what we have here is a very clever least-effort operation to keep the Senate nominally in business so that the Resident can't make any recess appointments.

As long as the Senate remains in session, Alberto Gonzales can't resign to spend more time with his family while Our Fearless Leader appoints a new criminal to the position of Attorney General without Senate approval.

So whatever the outcome, this hearing helps keep the Bush Administration painted in a corner.

34. Of course we have the votes - all it takes is a simple majority in the Committee
To get the measure moved to the full Senate. The problem there will not be getting the simple majority to have the Contempt Citation issued, it will be getting the 2/3 vote needed to end debate on the matter.

The FISC is in a similar position. After two unfavorable rulings, the Administration has decided to take its toys and go home; the amendments to FISA basically turn the FISC into a rubber stamp for the Administration. So the Court's call for more briefing seems like a hopeful attempt to restore the quaint separation of powers mandated by the Constitution.

At any rate, I'm wondering whether the FISC's efforts to restore that balance will once again fall victim to the Administrations pre-emptive temporal jujitsu. The deadlines the Court set for briefs were:

Administration response: August 31, 2007

ACLU reply: September 14, 2007

Yet today's WaPo reports that the Administration has a deadline, today, that they're going to miss.

Today at 2:30 p.m., the clock runs out on the latest deadline for the White House to turn over materials regarding the National Security Agency's eavesdropping program to the Senate Judiciary Committee.

The White House is likely to miss that deadline, counsel Fred F. Fielding warned committee Chairman Patrick J. Leahy (D-Vt.) on Friday. The work to compile the documents demanded by the senators -- from the White House, the office of the vice president, the National Security Council and the Justice Department -- is "by no means complete," Fielding said. He asked for an extension until after Labor Day.

The committee's original due date of July 18 was already pushed back once at the White House's request, and Leahy did not appear eager to grant more time.

Let's see. If they had made the July 18 deadline, Congress may have learned some things that would have made them think twice before caving to the Administration's demand on FISA. Conveniently for the Administration, they were unable to make the deadline, even though the terrorists were primed to strike during August.

And now, if Fielding holds off until "after Labor Day," he'll put off any scrutiny of the program until the September Iraq and budget vetoes debate hits full swing. Perhaps just as importantly, it'll mean the debate on FISA will be stalled until such a time as the Administration convinces (it hopes) the FISC that it cannot publish any of these opinions. Which, of course, will make the debate on immunity for the telecomms, which Bush will be demanding after the break, will again be bereft of the most important information.

It's all a delicate stall tactic, trying to put off the disclosure of real information until after such a time as it is too late.

Update: Spencer Ackerman has some updates. The long and short of it is that Leahy has flown back to DC from his cow-tipping in Vermont, and will have a press conference at 2:30, the deadline for the materials.

We all know that Gonzales is going to sit on any conventional contempt referrals to the DOJ.

By all rights, Leahy should be skipping the DOJ and sending the Sergeant At Arms to jail people and seize evidence. Congress can and has done that in the past.

73. I think that because
the subpoenas were issued by the judiciary committee, and the response had to come officially from the committee. WIth him there, the committee was in session (the press conference took place in the room where the committee normally meets). The strict rules of the Senate, I guess.
