1. I think the government shouldn't be able to use that information...

unless people are given a sort of Miranda warning when it is being given to a company:

"The information you provide to this company may be sold to another company at a later time. In addition, this information may be provided to the government, even if the government only purchases the information through a contract and does not present a warrant. That information may be used by the government to prosecute you in a court of law. Do you understand the previous warnings about the information you are about to provide?"
