1. This woman should have hired a lawyer a long time ago
Her story was posted here yesterday. Why didn't she have an attorney? Why did her husband not have a will?

Just a bunch of bad decisions.

let's see how that plays among those of us who don't have the necessary RESOURCES to hire an attorney:

Early in my advocacy for survivors of relationship violence, I encouraged a survivor to discuss her case with the attorney who provided pro bono services for our women's shelter. This survivor had finally left her abuser when she woke up to find him inserting the barrel of his pistol into her mouth (her quick thinking to survive THAT is a LONG story--she endured four hours of uncertainty as he waivered between shooting her and raping her).

When we got to the attorney's office, the survivor started to share her case history. The attorney threw up her hand, ala Fran Drescher, and asserted, "I can't hear anything about your case until you pay me a $500 retainer!"

Needless to say, this newly single, frightened, and shattered mother of two toddlers did not have even one-tenth of what this attorney demanded.

You might want to rethink your callous assertion that 'different choices' might have made this individual's situation less dire.

Are you assuming she was sitting on that retainer hoping to save some money? Is she well versed in legal aspects?

Seems the results are very unfair for this woman. Doesn't that count for you?

I can't think of a state where the surviving spouse doesn't automatically gets everything when one member of a married couple dies and there is no will.
