Texas high criminal court denies DeLay's requests

AUSTIN, Texas An appeals court today refused to dismiss money laundering charges against Congressman Tom DeLay's request or send them to a lower court for immediate trial.
The Texas Court of Criminal Appeals denied the requests with no written order two days after the Sugar Land Republican announced he was stepping down as House majority leader.

DeLay was forced to temporarily relinquish the post after he was indicted on money laundering and conspiracy charges in September. He denies wrongdoing.

DeLay and his attorneys had been trying to rush to trial in Texas in hopes of clearing his name and allowing him to regain the position. All that changed Saturday when DeLay announced he would not attempt to reclaim the job.

The House is expected to hold leadership elections when lawmakers return to the Capitol the week of January 31st.

DeLay and two associates allegedly channeled 190-thousand dollars in corporate cash through a Texas and national G-O-P fund-raising bodies to G-O-P state legislative candidates.

3. His tactical decision.
He can't have both a speedy trial and take the refusal to dismiss the charges up the appeals chain. He can either have a trial, or wait to hear what the appeals court says. But he can't do both at teh same time.
