Which state wants to ban sex toys?
I think it was Tenessee....

Anyway, one of the specifics of the ban is that it only applies to "3 dimensional" objects. Why? Because they know if they tried to ban pictures it would get blocked by the courts as banning free speech.

So, what would happen if you did own "3 dimensional" sex toys, but displayed them in a cabinet or on your coffee table? Now, its art. And art is protected free speech.

Adult business sues to get sex toys back

SPARTANBURG -- An adult-oriented business raided last month is suing the Spartanburg County Sheriff's Office to get its sex toys back.

Attorneys for Priscilla's say deputies violated the company's constitutional rights when they seized more than two dozen movies and 500 novelty items, mostly sex toys.

Sheriff Chuck Wright said Tuesday that last month's raid was legal and no items will be returned.

"They're not getting anything until the lawsuit's through and we go through the courts," Wright said. "They can demand all they want."

I'm in Ohio, and according to the law, every movie in my inventory is illegal to sell. I can be arrested and charge with a felony. Problem is, no one knows if the movie is actually obscene until a jury finds it as such.

The way the law is written, I could be arrested for selling a copy of Playboy magazine.

That's so ridiculous. How is this any of their business, anyway?!

A sex act can be made illegal, but I would not have thought it possible to make a sex toy illegal. That is a big assumption on their (meaning nosy people who can't mind their own business) part, to assume that the object will be used in that way. Some people give them away at parties for gag gifts, for a laugh.
The problem is these nosy people whose minds are swirling around naughty acts. They are the ones who can't stop thinking about "immoral acts". Maybe they pass these laws to keep themselves away from the sex toys, like they can't keep their hands off them, LOL.

I don't want their dirty fundie minds imagining what I might or might not be doing at home. That's an invasion of my privacy, and their snoopiness makes me feel violated. Have they no boundaries?

32. Actually, under Lawerence vs Texas
a consentual sex act done in private and not for monetary gain can't be made illegal anymore. But they can still go after "obscenity" which can be movies, magazines, etc, or even sex toys.

As it is, there are Obscenity laws on the books in 40(?) states. Most of these laws are written so broadly that you can be arrested for selling Playboy magazine. Adult stores exist in tolerant communities in these states, because it is not worth the hassle and bad press to prosecute them.

Anyway, sex toys are not 3-dimensional: they have at least 4... and possibly more, depending on which flavour of string theory is currently in vogue. That's your defence right there.

I live in Alabama and I think sex toy's are illegal in Georgia as well. You can get up to a year in prison if convicted here. Unless the law was recently overturned, I dont think it was though.
