Update on Bella
Just wanted to let you guys know, she was moved to Krome last night. It is 130 miles away from her attorney and family. She still does not have medication. Please call Senator Nelson's office and every member of the House from Florida.

ALLEGATIONS OF SEXUAL ABUSE AT KROME DETENTION CENTER
The INS Office of Internal Audit and the Justice Department Inspector General are investigating allegations that numerous officers at the Krome Detention Center in Miami had sexual contacts with the detainees. While the government has not released the names of those involved, or even how many people are being investigated, at least two officers at the facility have been temporarily reassigned.

Among the most serious allegations are two women’s claims to have become pregnant while in detention, one by another detainee, and the other by a guard, and claims that a transsexual detainee was sexually assaulted by a guard. The transsexual, a man in the process of changing his gender, was originally placed in a men’s dorm. Because she was involved in sexual incidents (it was unclear if they were forced or consensual) she was moved to a room by herself. According to the detainee, the male officer assigned to watch her raped her.

These are the most serious charges of sexual abuse at the facility since 1990 when a group of Haitian women claimed they were being forced into sex by male guards. The FBI investigated the charges, but never released any public statement on the results of the investigation.
If the investigation shows the charges are well-founded, it could lead to internal discipline, or even criminal charges.

Refugee Women and Immigrants Subjected to Abuse by Guards

New York, NY- October 5, 2000—In a report released today, the Women’s Commission for Refugee Women and Children documents widespread sexual, physical and emotional abuse of detainees held at the Immigration and Naturalization Service’s Krome Service Processing Center in Miami.

"Detainees told us of sexual abuse ranging from rape to molestation and harassment," says Wendy Young, Director of Government Relations for the Women’s Commission and author of the report Behind Closed Doors: Abuse of Refugee Women at the Krome Detention Center. "At least 15 male INS officers were involved. Women described an atmosphere of fear and intimidation."

The Women’s Commission visited the Krome detention center in March 2000 and again in September, following reports of widespread misconduct. The Women’s Commission has been at investigating conditions of detention for women asylum seekers in the United States since 1995.

Women at Krome reported that often officers used the women’s lack of immigration status as an inducement to participate in sexual activities. They reported that officers would make false promises that they could release a woman from detention if she participated in sexual acts. In other cases, detainees said that deportation officers threatened them with deportation or transfer to a county prison if they resisted a guard’s sexual advances or if they complained.

Complaints about severe overcrowding, prolonged detention, impediments to legal representation, verbal and physical abuse, lack of proper medical care and other abuses at Krome are not new and the facility has been the subject of federal investigations of alleged abuses every few years going back to 1986. Allegations of sexual misconduct are now being investigated by three agencies of the Department of Justice: the Office of the Inspector General, the FBI and the U.S. Attorneys Office. Two officers from Krome have been convicted by a grand jury.

"The INS must immediately regain control of Krome," says Young. "Strong measures must be taken to ensure that staff who have participated in illegal and unethical behavior are either criminally prosecuted or subject to appropriate disciplinary action, including dismissal. Accountability must be built in at every level of the INS from frontline staff working directly with detainees all the way up to the INS in Washington."

The Women’s Commission for Refugee Women and Children is the only organization in the United States dedicated solely to speaking out on behalf of refugee women and children. It provides expertise in the areas of reproductive health, protection and participation, asylum issues and refugee children and adolescents, Currently there are almost 50 million refugees and internally displaced civilians worldwide--80 percent of whom are women and children.

Human rights and humanitarian groups are calling for a full-scale investigation regarding the Nov. 3 death in a South Florida detention facility of an 81-year-old Haitian pastor four days after he had flown to the United States and asked for political asylum.

The Rev. Joseph Dantica, who had worked in Bel-Air, one of Port-au-Prince's poorest districts, for some 50 years, flew to Miami with his son, Maxo, on Oct. 29, after hiding for several days from members of an armed gang who had threatened to kill him.

He arrived at Miami International Airport with a multiple-entry visa stamped in his passport. Dantica was asked how long he intended to remain in the United States. Unable to give a definite date, Dantica and his son said they feared they would be killed if they returned and asked for political asylum.

At that point, both Dantica and his son were arrested. Joseph Dantica died five days later.

Datica's niece is the award-winning Haitian-American novelist and author, Edwidge Danticat. In a blistering column in the New York Times, she wrote: "Like the claims from Cubans, Haitian asylum claims should be considered fairly and humanely so that calamities like my uncle's flight and eventual death in the custody of the Homeland Security Department are never repeated."

when we ran the article, she was moved to Krome during the evening on a Saturday night... not that i have proof these things are related, but I am worried. i think grassroots is better right now, just in case.:(

she was picked up for no reason and it is not like i am not on the radar... there has been pressure to back off stories, some folks know about it, but i try not to discuss it too much. i have no proof these things are related to her, none at all. but then we ran the story and she was moved right away, in the evening, over the weekend. it just seems very odd.

"Maryanovsky claims that she is currently being held in a jail cell with an accused murderer. Last week she was in a cell with five other people and only two beds, so she slept on a “urine-laden cement floor.”

To make matters more disheartening, Maryanovsky takes medication for heart arrhythmia and high blood pressure. She confided to her family and friends that prison personnel mockingly refused to give her medication, telling her, “When you have a heart attack, then we’ll help you.”

One friend, Lauren, who wished to keep her last name private, said that she has visited Maryanovsky twice, and her ankles and extremities are swelling. “ can go into heart failure,” Lauren told RAW STORY. According to family members, her blood pressure hit 220/110, and the family obtained a doctor’s letter to present to immigration authorities, but she was still apparently not being given her medication.

Maryanovsky is scheduled soon to be transferred to Krome Detention Center, outside Miami, according to Sedikov. Two years ago, Krome garnered much press attention when an 81-year old Haitian Baptist minister, Joseph Dantica, died while being detained there after seeking asylum. He fell ill during his hearing, after, like Maryanovsky, requesting medication for high blood pressure. Officials contend that he died of pancreatitis and deny responsibility for his death. "

They are trying to kill her. Every day one goes with high blood pressure, damage is done. And having to go without medication for a heart patient is every bit as frightening as torture. Plus, a heart gets used to the medication, so denying it causes a "rebound effect" that can cause cardiac events.

God damn them!

Thinking that she both has her show and has ties to Florida, so she may be able to help. I've never sent an email to her before, so I am thinking that if any of you have established ties or connection to her that might weigh more.

Understand the importance of calling everyone and agree with it, but at the same time, would it help to flood someone, maybe Wexler's , office with calls and letters?

This lack of medication thing really bothers me (I am a heart patient, myself). No one should go without medication for an ailment such as that.

If the family can talk with her, can they get her medication, as well? Is she completely incommunicado, or are the ICE just putting up barriers when lawyers and reporters show up?

What is that guard's name? The one who mocked her.

What was she convicted of way back when?

More specifics would be helpful if anything is to be done on this matter. This needs to be a public as possible, and the details would help formulate letters and provide ammo for phone calls.

From what I understand the family hasn't been able to get her meds

the family doesn't know why she is being detained, there is only speculation

The place she has been taken to, Krome Detention is a bad place, under investigation for abuse as in the OP's links.

I don't have any idea what she was convicted for, but from what I've gathered reading up on this, it should be irrelevant, unless laws in the 80's made it retroactive. Yet it took them until 2006 to catch up with her on that?

This is fascism masquerading as "security", as fascism usually does.

Keep asking questions though, it's important to find out all we can to be able to help.

58. As far as i know...
The family is allowed a scheduled visit and they must wait in line, be searched and if clothing too "pocket" oriented, they have to change into somethng provided to them. Only one person is allowed to see her at a time (still trying to confirm this part because everyone is so hysterical i cannot get them to focus). They cannot bring anything in. Her doctor called the facility before she was moved, the jail, and nothing. The doctor provided a written note indicating that she needed her meds, and still nothing.

she talks to family behind a glass thing with a phone.

I don't know the guard's name who mocked her and neither does she, it seems. It tooks some heavy lifting just to get the arresting officer's name (he is in article) and he did not want to discuss it.

But perhaps the ICE spokesman would be a good person to send letters to asking these questions, because he is the agency PR person and he needs to answer them. Also, the state prosecutor for DHS (i listed somewhere in this thread).

Let's all head to Krome, that facist building holding women and children. If people will go, I will find a way and some money and go down there also... i don't live near there, so I need to get a hotel. but if we all go, then perhaps we can all bunk together. Trying to get my editors to let me go down there.

54. UPDATE II
Today is Yom Kippur, the holiest holiday in the Jewish tradition. Bella has not been allowed to see a rabbi or been given access to prayer books of any sort.

We are having a family meeting tonight to discuss next steps, so I should have more later. Her mother told me that Bella does not know that there was an article and that so many folks are fighting for her. Apparently the family decided not to tell her until she is out because she is afraid and they don't want to worry her that she may be retaliated against. But her mother, girlfriend, my mother, and obviously me are all aware of your efforts and everyone feels very grateful and thankful.

Her mother said (and my father echoed) that this is not unlike the Soviets, but the difference is that you guys are fighting, putting up a fight against this tyranny. I agree.

Thank you and please keep going. I am sorry I have not posted more, but between work and this situation, I have hardly time to sleep.

I will post more when I know it, but for now, she remains detained, without charge.
