Well, with only 15 voting against, and only 3 in committee, his confirmation was pretty much a done deal...

38. And I just rec'd this from him:
Dear xxxx

If the history of republics present and past teaches one consistent lesson, surely it is this: Tyranny rarely arrives on the scene in a sudden dramatic moment that stirs the hearts of all patriots, and liberties are never usurped in a single outrageous act that arouses the public's ire.

Instead, freedoms disappear slowly, fading away under cover of night, disguised by false patriotism cloaked in the rhetoric of crisis. One by one, they disappear -- each blow at liberty a seemingly reasonable step -- until suddenly all is lost, and the time for citizens to rise up has fled.

That is why liberty has always demanded vigilance. That is why it has always been the duty of patriots to speak out against the slightest encroachment.

And that is why, in half a century of service to my country, I have never been more concerned about the integrity of our Constitution than I am today.

In scarcely five years, the Bush Administration has managed to imperil Constitutional freedoms that no demagogue in the two centuries before him has been able to disturb.

The Bush team pressed the nation into an aggressive, unprovoked war on pretenses that were not simply false but utterly fictitious. Historians will surely record the Administration of George W. Bush as one of the most arrogant Administrations in history -- one that has browbeat Congress into blind submission and rejected Constitutional limits on executive authority.

Support checks and balances -- Support Robert C. Byrd

Imagine the revulsion with which our Founders would look upon an Administration that asserts the right to spy inside the homes of American citizens with nary a check or balance in sight... save for two words -- "trust me." The eventual consequences of such hubris should send a cold shiver up the spines of patriots everywhere.

The genius of the Founders was to entrust a nation's liberties to the care of laws, not of men. And so they created an institution insulated from the political passions of the moment, which they hoped would check an overreaching president.

That institution is the United States Senate. For nearly 50 years -- more than one-fifth of the life of our republic -- I have been proud, and privileged, to be a United States Senator.

I refuse to dishonor my service in the Senate by exchanging my oath to uphold the Constitution for obsequious obedience to any president.

I spoke out against the war President Bush was so determined to fight in Iraq. I voted against reauthorizing the outrageously misnamed and badly flawed "USA PATRIOT Act." And under no circumstances shall I ever support an indiscriminate program of domestic spying.

Support freedom -- Support Robert C. Byrd

I know these positions do not come without a political price. History teaches us another lesson: Those who would diminish freedom smile in public while hiring hatchet-men to do their work behind the scenes. And President Bush has the most ruthless political operative in America today: Karl Rove.

Mr. Rove has personally identified me as a target for defeat in this fall's elections. The Republican Party has recruited a wealthy industrialist who has even hired the man responsible for the vicious Swift Boat attacks against Senator Kerry in the 2004 election -- evidence that there will be a rough road ahead in my campaign.

This is a White House that does not cotton to criticism. I expect every distortion for which this Administration has become infamous. But I am resolute. The Constitution means more to me than any campaign.

Besides, I have in my corner allies on whose support neither George W. Bush nor Karl Rove will ever be able to call: the Constitution of the United States and freedom-loving patriots like you who are willing to take a stand in its defense.

I know from your support of my campaign that you are among them. Now, as the campaign shifts into high gear, I need your help more than ever.

Support liberty -- Support Robert C. Byrd

Please visit my website and make a generous contribution to support my campaign. If you give $100 or more, I shall be pleased to provide you with an autographed copy of my book Losing America: Confronting a Reckless and Arrogant Presidency, which details the threat the Bush Administration poses to our Constitution. I receive no royalties on these copies.

Before our very eyes, the liberties on which America was built are vanishing. Vigilance and unity are our only hope. Please respond today.

Sincerely,

Robert C. Byrd
United States Senator

By the way, have things dried up and gotten back in order since your winter flood posts?

57. Hey there neighbor!
Yes, the Feinstein issue has been a problem for a long time. I am no longer going to just vote for her because she is the Dem candidate with the most money and incumbent. The fact that she voted for Hayden and some other votes have just gotten me to the point of saying "no more". This woman Colleen Fernald is really interesting to me and would be a far better choice. I want to send a message to DIFI that business as usual is not going to guarantee her the votes she counts on. If enough people feel that way and it becomes very obvious to her that people are not supporting her anymore, then maybe she will change her tune and start representing our interests or maybe, just maybe, we might end up with a better Senator to replace her.

Meanwhile, thanks for asking about the "flood"...things have finally dried out and been cleaned up, however we are now getting ready to move out of the house and "lift it" so that it sits above the Base Flood Elevation for future floods. With all the global climate change going on, my sense is that floods are going to be occurring a lot more in the future as a regular occurrence around here and other parts of the area.

Chris Floyd`s take

http://www.chris-floyd.com/index.php?option=com_content&task=view&id=670&Itemid=1

This is not exactly news, but the national Democratic Party is one big stinking dead horse. If they could muster only 15 votes against a man who has overseen the most extensive and intrusive violation of privacy in American history (although ``outright rape`` is a better term for what the Bush gang has done to Americans` constitutional and human rights), then what in God`s name are they good for? Sure, old Peeper-Creeper Hayden would have been confirmed in any case, given the Republicans` bootlicking obedience to the White House, but couldn`t the Democrats at have made a pretense of opposition? Couldn`t they have at least registered the slightest demurral against Hayden`s nomination?

No, they could not. They are a fetid sack of quivering jellyfish: spineless, boneless, brainless, useless. Now watch them come begging for your money between now and November: ``Oh please, give generously to our noble cause! We`re the only ones who can save you from the big bad Bushists!``

No, you`re not. You won`t stand up now, why should you stand up later? You won`t do anything except the same damn thing you`ve been doing for the past five years: acting as eager, willing enablers of evil. You`ve done it again today with this vote. You`ll do it again tomorrow. And the next day. And the next.

God Almighty, what a shameful day.

49. Exactly.
That's the same thing I've been saying. Yes, the asshat Hayden would have been confirmed regardless but why in the hell couldn't the Dems have at least pretended to be the opposition party? Apparently they're so sure that no one will vote them out of office that they figure they don't even have to bother to pretend anymore. The Dems are nothing but GOP-lite and they sure as hell won't be getting any money, support, volunteer time, or votes from me again. Fuck 'em all.
